Depending on the length of a lease, and how long it still has left to run, a tenant can apply to the Upper Tribunal to modify covenants that it may contain. In our latest article, we examine the recent tribunal decision concerning the Black Horse in Southwark in relation to which an application was made to modify a leasehold covenant to keep the premises open as a pub. This was holding up a residential development for which planning permission had been obtained. current value — equitable — comparable properties — rounded — garage differential Nino Dodaro appealed the assessment of his property at 93 Bird's Lane in the Township of King, arguing that the assessed values for 2021-2024 were too high. The Municipal Property Assessment Corporation MPAC proposed slightly lower values than initially assessed. The Assessment Review Board ARB found the current value to be $992,000 for 2024 and $667,000 for 2021-2023. However, the ARB determined that an equitable reduction was necessary, setting the values at $972,000 for 2024 and $653,000 for 2021-2023. The Township of King did not participate in the proceedings.
