It seems inevitable that these amendments to the 2018 Farm Bill would come. The reality is that the federal government was not going to turn a blind eye to the sale of intoxicating hemp-derived cannabinoids for long. From the Delta 8 THC issues to the THCa controversy, the hemp industry has been pushing the boundaries by exploiting legal loopholes. For those looking to sell intoxicating cannabis products, the proper channels are through the medical or recreational cannabis sectors. According to USDA National Institute of Food and Agriculture, "Hemp" refers to Cannabis sativa L. and any part of this plant—including seeds, fibers, derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers—containing no more than 0.3% delta-9 tetrahydrocannabinol (THC) on a dry weight basis. As I wrote in this article on Cannabis Business Times: "A proposed amendment to redefine hemp in the 2024 Farm Bill would effectively make the intoxicating hemp-derived cannabinoid market illegal. It also would hinder seed companies, breeders and cannabis flower producers from selling seeds and cannabis flower across state lines in the U.S. under what is considered a loophole in the 2018 Farm Bill." And it would even impact CBD, according to the U.S. Hemp Roundtable.

However, the legal categorisation of food products containing hemp remains unaffected. Classified as novel foods, CBD and hemp products cannot be marketed without authorisation. Using an established selective and sensitive method, Eurofins Food & Feed Testing laboratories in Germany can support the analysis of hemp flour and hemp oil to ensure they comply with the maximum levels set in January 2023. Cannabis Analysis Resource Hub Cannabis testing regulations in the United States are determined at the state level. Hence, a wide range of pesticide and mycotoxin testing is required to meet compliance standards. Most tests for these analytes include (exclusively, or in tandem with other analytical techniques) liquid chromatography coupled with mass spectrometry (LC-MS). Why THC Dominated Cannabis Monetization: Scientific manipulation favors high THC via lower water activity and moisture content, leading to potent strains. Among the strictest testing regiments in the industry, Missouri’s regulations require all cannabis products produced for the medical or recreational market to be tested in its final form, including pre-rolls. That means not only is the flower subject to testing, but your paper and any other ingredients as well, since anything can cause a failure that can see the whole product lot destroyed. In Missouri, both flower and pre-rolls, for example, must be tested by one of 10 state certified labs for: Moisture Content and water activity; Residual solvents and processing chemicals; Residual pesticides; Microbial impurities; Mycotoxins; Foreign materials; The “big four” heavy metals (arsenic, cadmium, lead and mercury) + Chromium; Cannabinoids; and Terpenes (if requested). https://lnkd.in/eJ_Hi5qD
