Effectively countering the other side's position in a construction arbitration requires you to: (1) have an iron-clad understanding of the contract and applicable law to dismantle any interpretations favourable to the other side (2) curate the documentary evidence that undermines the opposing arguments in a clear and logical manner (3) review the evidence and arguments so that you can anticipate their line of attack and rebut each point (4) challenge the other side's documents and expose any inconsistencies, biases or gaps (5) preemptively addressing the weaknesses in your case to demonstrate your transparency and confidence (6) frame your counterarguments in the context of fairness, good faith and the reasonable expectations of the parties in the contract (7) keep your cool under pressure, listen carefully, and be ready to swiftly respond to any new arguments or evidence presented by the other side The key is to outmanoeuvre the other side at every turn - anticipating their moves, undermining their credibility, and presenting a clear, compelling narrative that demonstrates why you are correct ___________________ If you want more of these insights, sign up for my newsletter: https://lnkd.in/g_mQDNGB ___________________
