By end-2024, mandatory industry codes and standards will be in force for all in-scope service providers under Australia’s Online Safety Act. Non-compliance could result in fines from eSafety Commissioner or even court-ordered service bans. Yet, for many service providers, the Australian OSA is difficult to understand, comprising not only codes and standards but also basic online safety expectations and various notice-and-action schemes. In the table below, I have broken down each regulatory instrument under the Australian OSA, including their core operational elements and applicability to the eight “sections” of online industry defined under the legislation. Most of the remaining provisions of the Online Safety Act are coming into force today. Don’t panic – thanks to s.51, duties under the Act will not take effect until Ofcom’s codes are finalised and in place. If you want to find out more about Ofcom’s draft codes, we’re holding an in-person event with experts James Moss, Sir Jeremy Wright, Emma Drake, Heather Catchpole and Shona O'Connell to discuss the consultation on the first illegal harms consultation. More details can be found here: https://lnkd.in/eui4PNt9 Keep an eye on your inbox for updates: Sections 100-103 on Information Notices are set to be activated, with no immediate guidance needed for implementation. In essence, Ofcom could begin issuing notices today, and there's a possibility they might do so early on. Section 100 empowers them to request information, while Section 103 allows them to specify a responsible person for compliance. Ofcom has expressed their intention to use these powers in 2024, including for obtaining revenue data and gathering information for their publications. #onlinesafety #illegalharms #onlinesafetyact
