An action to quiet title is generally brought resolve any uncertainty as to the ownership of a property. The term comes from the latin phrase quia timet which means “because he fears.” In New York, actions to quiet title are codified in Article 15 of the Real Property Actions and Proceedings Law. Because these types of actions determine ownership of real property, one would not expect to see a First Amendment defense applied in such an action. However, in an interesting case out of Kings County, a quiet title action was recently dismissed based upon a First Amendment defense. In a dispute over the ownership of real property between a German Lutheran Church and the Evangelical Lutheran Church in America and the Metropolitan New York Synod of the Evangelical Lutheran Church in America, the Court held that “neutral principles of law… cannot be applied to adjudicate plaintiff’s property claims which directly call into question the authority that has been vested in the synod to impose synodical administration which would allow it to dissolve the church and take control over its property.”  The Court further explained that “Plaintiff’s argument that it should not be subject to this authority because it does not want to lose its property ignores the inherent religious elements. In this regard, the decision to impose synodical administration over a church involves consideration by the Synod of such issues as church governance, religious doctrine and practice, scripture, and the spiritual well-being of the local church’s remaining members. One year after blistering audit, CSU schools are hiring staff to give back Native American artifacts, remains 🏫 California State University campuses are making progress hiring staff to return Native American human remains and cultural artifacts. The background: In a report released in June of last year, the California State Auditor said the California State University was not acting with enough urgency to return nearly 700,000 Native American artifacts and human remains housed at CSU campuses. Among other shortcomings, the audit said, the CSU Chancellor's Office had not done enough to make sure there was appropriate staffing at campuses to prioritize repatriation. What’s the pay range: For repatriation coordinator jobs, the pay can be up to $162,000, according to some job listings. What are the basic qualifications? A four-year university degree in fields like anthropology, museum studies, Native American studies, or historic preservation. Most important qualification: Being able to effectively communicate and work with Native American communities.
