Here are some considerations based on the provided discussion: 1- Market Dynamics: While there is an attempt to introduce market-based approaches within the National Disability Insurance Scheme (NDIS), the reality is that a pure market approach may not be feasible. 2- Price Mechanisms: Pricing within the disability space poses a significant challenge. The current pricing structures may not incentivize providers adequately, leading to a lack of market participation. 3- Goal Setting and Measurement: Effective outcome measurement requires clear goals and targets, especially in areas like therapy and allied health services where goal-setting is common. 4- Outcome Measurement: While there is transparency at the scheme level regarding outcomes, there is a lack of focus on measuring outcomes at the organizational level. Moving forward, there is a need for innovative approaches that strike a balance between market dynamics and the unique requirements of disability support services, ensuring that individuals with disabilities receive high-quality and effective support. The Victorian Disability Worker Commission regulates all workers in Victoria regardless of funding therefore if you have a reasonable belief that a disability worker has behaved in a way that constitutes notifiable conduct you must notify us. This applies even if you have told another body about your concerns. Notifying the VDWC does not impact any other requirements or obligations to notify other bodies or schemes, such as the National Disability Insurance Scheme (NDIS) Quality and Safeguards Commission, the Department of Families, Fairness and Housing, or the Commission for Children and Young People. You should make sure you are aware of all your requirements or obligations under all relevant legislation, regulations, schemes and policies. If a notification relates to a registered NDIS provider, the VDWC must refer the matter to the NDIS Quality and Safeguards Commission. However, we will continue to consider the notification and can still decide to take action. 🚨 A Plan to Increase NY Disability Benefits Appears to Have Failed! Shocking many NY legislators and advocates, the plan to increase NY’s mandated Short Term Disability Benefits (known as DBL) has been removed from the state budget over the weekend. After weeks of negotiations, no increases to the program were approved, with budget bills omitting the previous proposals. Gov. Kathy Hochul had included this proposal in her State of the State address and executive budget earlier this year. 👉 The program, which currently offers $170 per week as the maximum benefit, has not been increased since 1989. That said, many of NY’s surrounding states have mandated programs with richer benefits – many of them exceeding $1,000/week. Dr Darren O’Donovan has published a Conversation article: ‘NDIS reforms are still in limbo. What’s going on, and are people with disability getting enough say?’ In December last year, the National Disability Insurance Scheme (NDIS) review proposed key reforms to ensure the sustainability of the scheme and improve outcomes for people with disability. Its recommendations included a shift to an overall funding amount for each participant. It also called for state and federal governments to cooperate in improving support across the lifecycle of disability. In March, the federal government introduced a bill to implement a limited number of the review’s recommendations. Dr O’Donovan argues three dynamics in the bill have clouded the original vision of the NDIS review: an uncertain method for calculating budgets for individual participants; the use of legislative instruments that may stifle co-design with disability organisations; and the introduction of bureaucratic powers to prevent rorting that may make people with disability more vulnerable. “This bill commences a long reform process that can only succeed if it’s based on clarity, accountability and transparency,” writes Dr O’Donovan. “The voices and experiences of NDIS participants and their representatives are key to delivering people-centred reform.” Read more: https://bit.ly/3zWnCQA #LaTrobeLawSchool #LaTrobeUniversity #Conversation
