Although the statement made by the Office of the Public Guardian (OPG) in their post below is correct, whether it is wise for someone to set up their own lasting power of attorney (LPA) without professional advice is another matter. As a full member of STEP – Advising Families Across Generations, with the Diploma in Advising Vulnerable Clients, I have the qualifications to draft LPAs for clients. However, I prefer to focus on what I’m passionate about, which is to provide a safe pair of hands for people in vulnerable circumstances by using my skills and technical capabilities as a financial planner and a Society of Later Life Advisers later life adviser. In my view, it provides better outcomes for clients by me collaborating with fellow STEP members, who are legal practitioners, specialising in LPAs and wills. I would encourage people to NOT do as the OPG suggest and set up their own LPA, but to engage a suitably qualified practitioner to provide advice, particularly on important issues such as choice of attorneys and preferences and instructions, which often get overlooked with DIY LPAs. I cannot stress the importance of these documents for every individual - regardless of assets or age - if you want your loved ones to have the legal authority to look after you and make decisions on your behalf if you ever lose mental capacity you need to have Lasting Powers of Attorney in place.
