🚧 Should Major Hardware Suppliers be able to market products where they may not comply with Australian Standards? 🤔 There's a growing debate in the construction industry about material suppliers, selling products that may not comply with Codes and Standards. A major hardware supplier has been selling vinyl plank flooring labelled as waterproof. However, AS 3740 - 2021, referenced by the National Construction Code (NCC), does not recognise vinyl planks as waterproof materials. Under Clause 3.3 of AS 3740, only ceramic and stone tiles, as well as water-resistant flexible sheet flooring with sealed joints, meet the criteria for water-resistant surfaces. Vinyl planks, despite their labelling, do not qualify as they lack sealed joints, making them non-compliant with DTS provisions (📜). This oversight concerns me about accurate labelling and compliance with building codes and marketing and selling of products. Who would be responsible if this was installed by a builder and then subsequently defected by the certifying authority?🏗️

Thank you Vincent perhaps some regulators in Australia adopt some of the regulations. You told us in your summary of requirements. Here is part of our Maryland Consumer Protection Act Unfair, abusive, or deceptive trade practices include any: (1) False, falsely disparaging, or misleading oral or written statement, visual description, or other representation of any kind which has the capacity, tendency, or effect of deceiving or misleading consumers; (2) Representation that: (i) Consumer goods, consumer realty, or consumer services have a sponsorship, approval, accessory, characteristic, ingredient, use, benefit, or quantity which they do not have; (ii) A merchant has a sponsorship, approval, status, affiliation, or connection which he does not have; (iii) Deteriorated, altered, reconditioned, reclaimed, or secondhand consumer goods are original or new; or (iv) Consumer goods, consumer realty, or consumer services are of a particular standard, quality, grade, style, or model which they are not; (3) Failure to state a material fact if the failure deceives or tends to deceive; we also have § 2-316.1. (1) The provisions of § 2-316 (ed note disclaimer of warranties ) do not apply to sales of consumer goods, as defined by § 9-109, services, or both. (2) Any oral or written language used by a seller of consumer goods and services, which attempts to exclude or modify any implied warranties of merchantability and fitness for a particular purpose or to exclude or modify the consumer's remedies for breach of those warranties, is unenforceable. However, the seller may recover from the manufacturer any damages resulting from a breach of the implied warranty of merchantability or fitness for a particular purpose. (3) Any oral or written language used by a manufacturer of consumer goods, which attempts to limit or modify a consumer's remedies for breach of the manufacturer's express warranties, is unenforceable unless the manufacturer provides reasonable and expeditious means of performing the warranty obligations.

Racking Designers/Installers, your views would be interesting... In the refurbishment of industrial and logistics floors, there are often many thousands of redundant anchor bolts to be treated. It is becoming commonly specified that anchors are to be removed by coring, and the void filled with suitable epoxy mortar. For reinstallation of racking, do you find it acceptable to place new fixings into such repairs?

Lasting Ceiling and Wall Crack Repair Solutions for Parking Garages When Tenera was approached to provide repair specifications for an underground parking garage of a mid-rise condo building located on Bayview Ave. in Thornhill, our specialists conducted a comprehensive inspection to assess the condition of the structure. We then provided an application design to address wall and ceiling cracks, as well as enhance the aesthetics through a fresh coat of paint. Crack Repair: Ensuring Structural Integrity To ensure durable results, the contractor was instructed to adhere to the following repair method when repairing ceiling and wall cracks throughout the underground parking garage structure. The repair process must begin with chipping out the cracks to remove any loose material, thereby creating a clean surface for optimal adhesion. Subsequently, the cracks are coated with an industrial-strength adhesive to ensure sufficient bonding for the specialised crack filler material that follows. When installed properly, it seamlessly integrates with the existing structure. To provide additional protection against water infiltration, a waterproofing membrane is applied over the repaired cracks. Finally, the area is painted to match the surrounding area.
