In het artikel bespreekt hij de uitdagingen rond het indienen van een modelaanvraag, waarbij de manier waarop een model in het Register wordt weergegeven, bepalend is voor de juiste vastlegging van de uiterlijke kenmerken en de beschermingsomvang. Verder gaat hij in op de verschillende weergavevormen die in de EU worden gebruikt en de praktische implicaties daarvan. NO PINK SKIES AHEAD T-Mobile (Deutsche Telekom AG) recently lost three Benelux color marks that protected their Magenta color for telecommunication services. These cancellation procedures were filed in the name of Dutch claimant Lebara BV, who argued that the marks lacked distinctive character. In the Benelux, color marks are generally refused on this ground unless the applicant can prove that the mark has acquired distinctiveness through use. This generally requires substantial evidence throughout the territory of the Benelux. Lebara argued that T-Mobile’s evidence was insufficient to meet this high bar. On August 23, 2024, the Office ruled in favor of Lebara, canceling all three color marks. Despite T-Mobile’s significant presence and evidence in the Netherlands, their absence in Belgium and Luxembourg as a telecom provider in the consumer markets made it unlikely that the Benelux public would recognize the Magenta color as a trademark. The Office emphasized that the market survey results from the Netherlands – one of the pieces of evidence delivered by T-Mobile - could not be extrapolated to Belgium and Luxembourg due to differing circumstances and extent of use. Although T-Mobile still holds an EU trademark for the Magenta color, which includes protection in the Benelux, several cancellation procedures are still pending against this trademark. This means that the trademark might still be cancelled, obviously jeopardizing T-Mobile’s EU-wide trademark protection and might possibly leave them without any protection for the color as such in the Benelux.
