Historically, the courts have had little involvement in review of the Federal Emergency Management Agency's (FEMA) decisions regarding the billions of dollars of federal disaster recovery funding that FEMA administers annually. Legal professionals typically discourage pursuing judicial review of a FEMA denial of funding due to the discretionary nature of most of FEMA's programs and also the high level of deference given to FEMA's interpretation and application of the laws that apply. However, the United States Supreme Court is expected to issue a ruling this month that may nullify years of precedent through the anticipated overturn of the namesake case for "Chevron deference." If this occurs, pursuing relief from an offensive FEMA denial through an action for judicial review in the courts could emerge as a new option. This pending case where the US Supreme Court may overrule the precedent know as the "Chevron deference" is one of the last big ones on the docket left in this term. At issue is whether courts will continue to give deference to federal agencies interpretation of applicable laws and regulations they administer. This could have significant impacts to FEMA and the work in the Emergency Management space. Texas vs. New Mexico: The Supreme Court upheld the U.S. objections to a consent decree regarding the allocation of the Rio Grande waters between Texas and New Mexico. This case addresses the decades-old conflict over water rights, providing a definitive resolution to allocating water resources from the Rio Grande River. KEY POINTS: • Historical Conflict – stems back to 1938 when an agreement was made between Texas – New Mexico and Colorado • Texas’ Claimed – New Mexico diverted more water than allowed under the compact. • A “Special Master” – who had been appointed by the Court to investigate determined that, yes, New Mexico was in violation. • Supreme Court – ruled in favor of Texas IMPLICATIONS • it sets a precedent for future water disputes and highlights the need for cooperative water management among states.

Eric Wohlwend’s Proponent Testimony: The Truth About Ohio’s Water Bill Crisis. Cities refuse to turn of water when tenants live in our private homes. Then they put liens on our property so #bigwater can be paid by the property owners. While we have a lien on our property. The water company signs the very same tenant up at another property so they can run that water bill up and not pay for what they used. It is not legal for property owners to turn off the water. Only water companies can do that. #Bigwater is the only utility that has passed the responsibility of collections on to property owners without giving us the ability to stop service. If they cannot do their own collections, perhaps they should sell to Aqua Ohio or another private company. They could learn how the gas and electric company collect from the people that use their services. #Bigwater could learn from any other business on earth,how people get paid for providing service.
