Fighting #misinformation or protecting freedom of expression? In this ruling from last week, the Brazilian Superior Court of Justice (#STJ) upheld YouTube’s right to remove videos containing medical misinformation during the COVID-19 pandemic. The Court emphasized the necessary balance between content moderation and freedom of expression. #YouTube - as an internet application provider - has the right to moderate content on its platform in accordance with its terms of service. Yet, this right is not absolute and must be exercised within the limits of the law, respecting freedom of expression and prohibiting censorship. In this case, the Court held that the removal of the videos did not violate the plaintiff's freedom of expression and was a legitimate exercise of content moderation. The ruling underscores the importance of internet platforms aligning their content moderation policies with legal and constitutional standards, to safeguard freedom of speech while preventing the spread of harmful misinformation. #newsalert MEDIA AND DIGITAL PLATFORMS MARKET INQUIRY: COMPETITION COMMISSION CALLS FOR MORE INPUT The Competition Commission has published a press release calling for input by 22 January 2024 on ‘a further statement of issues’ to be explored during its market inquiry into media and digital platforms. The inquiry began in October 2023. Identified during the first phase of stakeholder consultation, the issues are grouped into themes. They include: * ‘the incorporation of constitutional interpretation into the inquiry’ * ‘the impact of mis- and disinformation’ * ‘the emphasis on radio and TV broadcast news media (especially the public broadcaster) * ‘the measurement of news and its benefit to search and social media platforms’ * ‘revenue share arrangements between news media and digital platforms’, and * ‘the role and importance of transparency in platforms and advertising technology markets’. The press release encourages stakeholders and market participants to provide reasons and corresponding evidence where appropriate. Are recent #Internet #regulations effective in curbing the supposed “torrents” of hate speech on social media platforms, as some public officials claim? Or are these policies having the unintended consequence of platforms and users going overboard with moderation, thereby throwing out legal content with the proverbial bathwater? Researchers at The Future of Free Speech, Common Consultancy, and Analyse og Tal F.M.B.A & Tal tested policymakers’ claims that social media platforms were overrun with illegal hate speech. They gathered comments from 60 of the largest #Facebook pages and #Youtube channels in #France, #Germany, and #Sweden and tracked which comments disappeared within a two-week period between June and July 2023. #Legal experts collected and analyzed 1,276,731 comments to determine whether they were illegal based on the relevant laws in effect in each country.
