Remote with specific location requirements as in being in a certain state is valid. Remote simply means without needing to be in the physical work location - it’s not always going to be a free for all and that’s not a bait and switch There are lots of reasons that could be that have nothing to do with the role and everything to do with logistics behind the scenes that aren’t readily apparent to someone who doesn’t know the ins and outs of the company and how it’s run Here’s some of the things we ran into the moment we wanted to hire someone outside the state we worked from We paid thousands of dollars to run in multiple states and countries. Because we were super small a PEO was more expensive than we could afford at first (we have one now thank god!) First off we had to register our LLC in each state and pay that fee. we had to keep up with multiple sets of labors laws, pay multiple sets of taxes and in a few instances keep multiple sets of insurance policies. We had to pay into multiple states unemployment and workers comp and make sure all our withholdings were correct for each of these. Handled by payroll but did incur additional costs to set up and additional reporting we had to keep an eye on. We had to sort out having to abide sometimes by different and sometimes even conflicting labor laws, negotiating health plans across multiple states is expensive and nearly tripled our health insurance costs to be able to provide good coverage. Another one example remote classification laws. California for example has very strict rules on how you classify remote workers that a company who is based in Utah may not be able to meet so legally they can’t hire you. Thankfully that’s not an issue for us since we classify people under this strict law but going the other way maybe not so much And those are just the things I pulled off the top of my head. A business isn’t going to take on that level of cost for a single employee. It doesn’t make sense. So rethink this idea of being remote being that everyone should allow everyone in. Logistically that’s just not always going to be possible. If they have a state constraint they’re gonna have a business reason for it. That job is still a remote job if they don’t require your presence in a standard work location.
