Following last weeks communications on recent SQE1 results, As Chair of the Solicitor Trailblazer Group, I thought it useful to follow up with some key takeaways from the recent meeting with Kaplan. There is a lot of misinformation in the market and so hopefully you will find the below useful.
There were 13 Apprentices affected by this error.
The main misunderstanding is about the compensation, the way some of this has been reported has been misleading, Kaplan are offering £250 goodwill payment to all candidates who were incorrectly told they failed. Compensation for losses incurred by candidates will also be paid. Kaplan realise the error will have had a significant impact on the 175 candidates who were wrongly told they failed, and in different ways. Kaplan are encouraging candidates to contact them about their losses and the personal impact the issue has had on them including missed progression opportunities, mental health etc. They will be dealing with candidates on a case-by-case basis and there is a real commitment, to do what they can to put candidates back into the position they would have been in had this not occurred.
Kaplan would like to apologise to everyone, it’s a regretful situation and they hold their hands up to the mistake. There is also some confusion over the scaled scores. Kaplan will be publishing a further explanation on this.
The inaccuracy was entirely a calculation error as the raw scores were converted to scaled scores. It has been reported by some as a marking error, but this is incorrect, there is no doubt over the number of correct answers any of the candidates achieved. No one has had any amendments to the number of answers that they answered correctly. The explanation they are planning to publish will provide some reassurance on this.
Kaplan provided assurance this hasn’t happened before as scaled scores had not been used before. As importantly, it won’t happen again.
The standard appeal window is open and will close at 5pm on Monday 29 April. Kaplan do not want students to feel they have to submit an appeal to gain reassurances about their result, but this has been triggered given this now constitutes as a new decision from the assessment board.
Kaplan have communicated clearly to the group of candidates who had registered for a space on the April SQE2 sitting, and has committed to find them a space if they wish to sit in April. The sitting will be free of charge and will also be free of risk.
Kaplan’s attention will now go to the scope of the review. They would like the review to be broader and not just to focus on this particular issue but to look at their change management strategy as ultimately it was a change that caused this error and to prevent risk of future errors.
