Brainbox Director Tom Barraclough has released a paper today drawing on previous work on artificial intelligence, as well as other projects looking at conversion of law into computer code (often known as "rules as code"). The paper looks at governance arrangements for New Zealand's sale and purchase agreement for residential real estate to suggest how the legal components of rules as code systems might be governed to build confidence in the system's reliability. It also suggests how AI governance frameworks might apply to automated decision-making systems driven by computational versions of law and legislation. You can also access an updated version of the UN Global Digital Compact, which marks up changes in the updated revision draft. Find out more below!

Delighted to share this great contribution by Professor Mira Burri and María Vásquez Callo-Müller; the article (a response to my 2022 article on FTEs) is based on their deep expertise in and extensive work on TAPED (Trade Agreements Provisions on Electronic Commerce and Data) Dataset, which tracks preferential trade agreement concluded since 2000. A recent decision by the German Bundesgerichtshof found that AI-generated inventions can be registered for patent in Germany, with a natural person listed as the inventor, as long as the requirements for patent protection under German law are satisfied.
