Not much more detail on the key issues of zero hours contracts, notice for shifts and day one rights - looks like we will need to wait for Regulations for more information - there are new clauses in there extending the time limits for tribunal claims, introducing new rights for seafarers and applying the day one right to SSP in Northern Ireland. 📢 Reflections on Labour's Victory and Its Impact on UK Employment Law As an HR practitioner who’s navigated the ever-evolving landscape of employment law for over a decade, I find myself reflecting deeply on Labour's recent victory and the potential changes it heralds for UK employment legislation. Labour’s win is poised to bring a wave of transformative changes, many of which directly impact our daily responsibilities in HR. From promises of stronger worker rights to enhancements in workplace equality, the anticipated reforms align closely with the values of fairness and inclusion that we strive to uphold in our organisations. Here's a snapshot 📷 of the key changes we can expect: ⭐️Day one right for unfair dismissal applying to both employees and workers. ⭐️Banning zero hours contracts. ⭐️Increasing the time limit to pursue an Employment Tribunal claim from 3 to 6 months. ⭐️Removing statutory limits on compensation that can be claimed in the Employment Tribunal. ⭐️Banning fire and rehire processes. ⭐️Changing the 3 tier employment status structure to a 2 tier (combining employee and worker status). ⭐️Introducing a flat rate for NMW for all age groups. ⭐️Expanding equal pay legislation to apply to those with disabilities and BAME employees. ⭐️Changing Trade Union Rights. ⭐️A right to switch off from work. ⭐️Entitlement to SSP from day 1 ⭐️Introducing a right to bereavement leave These changes, set to be implemented within 100 days, mark a significant shift towards more equitable and fair work practices. 💼 HR Practitioners: What are your thoughts on these proposed changes? There’s an almighty collision coming down the track for many Hiring companies and their providers. This summary is just one example of the reforms within the Bill - is a good example and hopefully the wake up call and catalyst for employers to take a serious look at their recruitment/employment practices and strategies. ‘C - type’ employers - that could be characterised as; ❌ Having a use and abuse mindset when it comes to employment practices. ❌ Normalising shambolic planning and mis-management that gives rise to immoral and frankly unsustainable hiring/firing behaviour ❌ Treating agency workers as easy come/easy go second class citizens ❌ A wilfully blind and complicit race to the bottom - comprising everything from candidate quality, productivity, safety, culture, engagement. ❌ Will need to radically review and reform what they do, how and with whom. The remedy is simple: ✅ Commit to professionalise and invest responsibly in expert advice and guidance - partner with gold standard and reputable providers. ✅ Carry out basic workforce planning - end the reflex panic hiring - guanteed hire who’s available and rarely who’s best. ✅ Stop penny pinching - if a business has to abuse and suck and dive - it’s self evidently non-viable. ✅ Fix the culture - improve the leadership and everything gets easier and will improve over night. ✅ Invest to up, cross and multi-skill the workforce - just pay and treat fewer people better. It’s. That. Simple. Since Labour came to power they have, as promised, focused on bringing about significant reforms to employment rights. This culminated in The Employment Rights Bill, which was introduced on 10 October.
