Still shocked by the horrific and violent rioting witnessed in England and Northern Ireland in the last few days, with many workers from ethnic minorities from healthcare, hospitality, shopkeepers and gig workers being targeted with abuse, racism, harassment and violence. This article exposes the way that workers in the gig economy - with migrant workers making up a significant portion of this workforce- remain a 'highly visible, exposed, and predominantly racialised workforce who continue to be easy targets for attack'. It also points out how platforms must take all reasonably practicable steps to ensure the safety of gig/platform workers.

The level of collusion it takes to successfully pull off a ghost worker scheme in a government agency or MDA is insane. Bearing in mind that salaries are paid by a different structure entirely, it would need the approval of key players in the system to insert the names of ghost workers and pay them salaries. Since the bank verification number is tied to the identity of every person, imagine if these ghosts could be caught and prosecuted for stealing government funds and not just deleting their details from the payment platform.

UNITED KINGDOM: #Tipping policies and practices. The Employment (Allocation of Tips) Act 2023 is now in force across England, Scotland and Wales. This means that #employers in sectors where tipping is practiced, or service charges applied, must ensure that they comply with the Act by putting in place a system to deal with the fair allocation and distribution of tips. Companies must have a formal (written) tipping policy which has been drawn up after consulting with staff and also keep accurate records. One reason for this latter obligation is because employees now enjoy a right to request information relating to their employer's tipping records every three-months - plus details of records going back up to three years, or until they joined the organisation if that is a shorter period. The Act applies also to agency workers, but not self-employed #workers. #FedEE

British Columbia has become the first province in Canada to provide a minimum wage and other protections for gig-workers. Minimum pay is one of several new measures coming into effect in B.C. Other rules being introduced include: 1. All ride-hailing service and delivery workers will be covered through WorkSafeBC. 2. Companies will be required to see the location and estimated pay for a job before it is accepted. 3. If workers are suspended or deactivated from an app, companies must tell them why. 4. Companies must ensure 100 per cent of the tips paid by customers go directly to the worker responsible for the service. 5. Employers using cheap foreign labor to fill work shortages in Canada are paying more fines for violating the rules of a government program that allows them to temporarily hire employees from outside the country. Monetary penalties issued to businesses failing to comply with the rules of the Temporary Foreign Worker Program rose to C$2.1 million in the fiscal year ending March 31. That’s a 36% increase compared with a year earlier, according to data released Wednesday by Employment and Social Development Canada. Twelve employers were temporarily banned from using the program, compared with seven in the previous fiscal year, the report showed. A North Yorkshire food outlet has been fined £50,000 for employing five illegal workers. A second outlet was also fined £15,000 for employing one worker, who had no right to work in the UK. The penalties were released in a quarterly update from the Homes Office on enforcement activity. The latest data related to the period of January 1 to March 31, 2024 The government department said it had issued some 38 penalties across North East England, Yorkshire and Humberside. Altogether, fines totalling £790,000 were issued. Among them, Bitz ‘N’ Pizzas of 24 Flowergate, Whitby, was fined £50,000 for employing five who had no right to work in the UK. Bengal Spice Ltd of 47 Prospect Road, Scarborough, was fined £15,000 concerning the unlawful employment of one individual, who also had no right to work in the UK. No businesses in the York, Harrogate, or Selby areas were listed. However, others from Yorkshire were listed from Hull, Redcar, Doncaster, Rotherham, Leeds, Wakefield, Dewsbury. Typically, the businesses were in the take-away/ restaurant sector, but they did include several car wash operations, sectors the new Labour secretary Yvette Cooper is targeting in her efforts to tackle the issue. According to the Government, there can be severe penalties for employing individuals who do not have the right to work. In January this year, the previous Conservative government tripled the potential penalty to employers who failed to do proper “right to work” checks, up to a maximum of £60,000 per illegal worker. The move, announced late last year, came as part of a crackdown on illegal immigration, promising stronger action against businesses that either knowingly breach right to work check rules or don’t take appropriate measures to make sure they’re compliant. This included the first increase in “civil penalties” (fines) since 2014, jumping from £15,000 for a first offence and £20,000 for repeat offenders to £45,000 and £60,000 respectively. Gov.uk says: "You can be sent to jail for 5 years and pay an unlimited fine if you’re found guilty of employing someone who you knew or had ‘reasonable cause to believe’ did not have the right to work in the UK. This includes, for example, if you had any reason to believe that: They did not have leave (permission) to enter or remain in the UK Their leave had expired They were not allowed to do certain types of work Their papers were incorrect or false A Home Office spokesperson also told the Press: “We do not comment on individual cases, but we are determined to clamp down both on illegal working and the exploitative treatment of illegal workers.”

Hospitality recruiters are reminded that temporary agency staff must be included in the sharing of tips among all workers under the Employment (Allocation of Tips) Act. The new law, requires that staff be given 100% of tips, gratuities and service charges from customers. It came into effect on 1 October 2024. In addition, businesses must craft a specific tipping policy, and workers have a new right to request a copy of their tipping record. The Department for Business and Trade estimates that these changes will mean around £200m will be received by workers that would otherwise have been retained by these employers.
