📢 Important Update for Hospitality Employers 🍽️ Big news for restaurant and hospitality business owners! The U.S. Court of Appeals for the Fifth Circuit has struck down the Department of Labor's (DOL) 2021 regulation limiting the time tipped employees can spend on non-tip-producing tasks. This ruling means that the DOL’s previous limits on the amount of time your tipped employees can spend on supporting tasks (like bussing tables or other duties) without losing the tip credit are no longer in effect federally. What Does This Mean for Your Business? 1. The decision significantly simplifies the application of the tip credit under federal law. Employers no longer need to distinguish between tip-producing and tip-supporting work or monitor the time spent performing tip-supporting duties. 2. However, employers are still subject to local or state laws that are more beneficial to employees or that prohibit tip credits entirely. Maine law still has the 30 minute provision in place, but federally, the rules have been relaxed 3. And as was the case before, employers can’t take a tip credit when an employee performs tasks unrelated to their tipped occupation. For example, if a hotel waiter also does maintenance work, time spent on maintenance is not subject to the tip credit. Stay informed and make sure your payroll processes reflect this change. It includes provisions for full-time, part-time, and casual employees but excludes certain businesses like cafes and restaurants offering sit-down service. The award doesn't currently include shiftwork arrangements but details rest and meal break requirements. Wages are determined based on employee classification, with overtime and penalty rates outlined. Allowances for meals, cold work, and transportation are also specified. Leave entitlements, including annual leave, personal leave, and public holidays, are covered under the National Employment Standards.
