Guest post: It’s Time to Start Preparing Your Company for the European Union’s AI Act

On March 13, 2024, the European Union Parliament voted to approve the EU’s Artificial Intelligence Act, known as the AI Act. The EU AI Act will enter into force 20 days after publication in the EU Official Journal.
As the European Commission explained, the AI Act aims to establish a “comprehensive legal framework on AI worldwide” for “foster[ing] trustworthy AI in Europe and beyond, by ensuring that AI systems respect fundamental rights, safety, and ethical principles and by addressing risks of very powerful and impactful AI models.”

Regulation is a must.
An UN newly released report said that AI ONLY benefits small amount of states, companies and individuals.
In a more accurate human language in English, it should be that some human are using AI to harm others and thus, make big money.
AI is based on math models derived by some smart people.
Using math models to simulate a physical process started from the Manhattan Project in World War II for nuclear bomb design.
Today's AI was originally from the military C4ISR. Its original missions were just breaching enemy's security, dis-/mis-information, cognitive manipulation, cheat, surveillance, etc..
We can imagine using AI to do many things, but NOT everything, at least NOT what we are doing, by using our intellectual property (IP), a copyrighted multilingual metadata.
Metadata is an enabler.
Without metadata, NO data can be found/retrieved, even by the most advanced technologies, like AI, NVIDIA chips, supercomputers, etc.

Recently collaborated with Heather Dawe on the EU's AI act, resulting in an insightful article featured in Euronews. As the EU AI Act takes effect this week, it marks a significant milestone in global AI regulation, emphasizing risk-based controls. The legislation, passed in March and published in July, introduces a structured approach, categorizing AI systems into four risk levels, including prohibited AI.
Heather Dawe, head of responsible AI at UST, highlights the importance of timely compliance for companies, stressing the need for proactive measures to align with the new regulations. International clients are already engaging in the process, recognizing the necessity of AI governance.
Non-compliance could lead to penalties of up to seven percent of global annual turnover, underlining the urgency for companies to adapt swiftly. Dawe advises setting up internal AI governance boards for comprehensive audits and alignment with the law.

There is some very practical info in here. While it’s still early days, the time to be assessing your current and future AI use and deployment is 💯 now. Having a solid roadmap and policies in place is going to better position you as legislation ramps up. And it is absolutely ramping up.

It now looks likely that it will be July/August before the Artificial Intelligence (AI) Act is published.
Partner and head of the firm’s Technology Group, Sean McElligott considers the Article 5 prohibited practices, which will be expressly prohibited throughout the EU within six months (most likely January/February 2025). Does the vagueness of the wording mean that the net has been cast too widely?
