Size matters... Never imagined I would play for a team that moves at this kind of speed. It's incredible. As we race to 1,000 lawyers and 35 national office locations (and simultaneous fly down the AMLaw100), it's important to reflect on why: The answer is leverage. Subject matter experts working beneath subject matter experts, each individually better at their niche than anyone that I've ever encountered professionally - all accessible within seconds at scale. Rather than continually pounding square pegs into circular and triangular holes, getting to the wrong destinations and spending needless delay and money along the way, we have square pegs, triangular ones, circular, hell hexagonal...and each shape in 20 different sizes. We have people that not only do IP... within that they do software IP...and within that do Gen-AI Data Privacy related issues...and within that do Gen-Ai Data Privacy issues related to licensing IP to the government...We have "Space Law" people for Christ's sake. It's amazing. No wasted bandwidth. No needless delay. No spending 5-10x on a project using someone "less expensive". Giving thanks to The Team...and making dreams come true at scale. 👨🚀 🚀 Cheers.

Now this is exciting. It’s the abolishment of the “forms” of action and the merger of law and equity. But just because the FRCP uses different vocabulary for the same thing doesn’t make one synonym “wrong.”We can all agree that in Illinois law there are things called “causes of action.” And District Courts presiding over diversity actions apply Illinois law, in approximately one diversity case out of fifty. But the federal courts only apply the substantive law of the applicable state, not the procedure. Except when District Courts are presiding over enforcement of money judgements. So Easterbeook is really onto something really important in the quote. But His Honor forgot rule 2: “There is one form of action—the civil action.” “Adoption of the Federal Rules of Civil Procedure in 1938 merged law and equity into a single civil jurisdiction and established uniform rules of procedure.” https://lnkd.in/gcqQk9hi.

In the recent oral argument in Roberts v. Smith & Wesson Brands, Inc., Judge Easterbrook said the following: "There is no such thing in federal practice as cause of action. The word is claims. So I'm happy if you stick with claims. Causes of action in federal court were abolished in 1936." What could be the fate of the claim of Alves, if he had filed the case in Ohio's US District Court, especially when there is a forum selection clause in the terms of use of the website? If Alves had filed his claim in Ohio, whether the District Court at Ohio could legally interpret the provisions of privacy laws of Massachusetts, on the basis of which the claim was filed in District Court located in Massachusetts? When a Massachusetts statute was the basis of claim of the plaintiff, and, prima facia, Goodyear has violated the said statute, then should it not be appropriate to try the case instead of dismissing the same summarily?
Alves v. Goodyear is an unremarkable reminder of the time wasted on dumb lawsuits, in this case because the internet is not enough to confer personal jurisdiction everywhere a website is accessible. In signing the Order, Judge Young took the opportunity to commemorate his advancement to senior status, with a tribute to Hon. Peleg Sprague (D. Mass. 1841–1865). Cheers! 👏👨⚖️
