"How can transit fees be imposed on the airspace of the exclusive economic zone? This question arises when considering the rights of the coastal state over the economic zone, particularly in relation to exploration and exploitation. These rights are governed by the principles outlined in the International Sea Law. To ensure compliance with these principles, it is important to explore the possibility of implementing transit fees for the use of airspace within the exclusive economic zone. This would be similar to the rights granted to the coastal state for the exploration and exploitation of resources within the economic zone. By imposing transit fees, the coastal state can exercise greater control over the airspace and potentially generate revenue to support the management and protection of the exclusive economic zone."

Perhaps, it is time to think about introduction of additional Associated Protection Measures under the Baltic Sea PSSA, e.g. restricting operations of “shadow tankers” fleet, limiting discharges of certain noxious liquid substances and discharges of sewage and food waste from all ships and introducing underwater noise reduction measures (slow steaming, re-routing, propeller maintenance)? We know enough to act!

It was therefore identified as a Particularly Sensitive Sea Area (PSSA), excluding Russian waters, in 2005. A PSSA is a comprehensive management tool through which environmentally sensitive sea areas can receive additional protection through the IMO.🆘 #HELCOMThroughHistory

📢 The 10th session of the Implementation of IMO Instruments Sub-Committee (III 10) was held in person in London (22 – 26 July 2024). Dive into our full report on III 10 here: https://lnkd.in/ewinfsmu 💡 Notwithstanding the usual agenda of III (safety investigation reports, PSC procedures, survey guidelines), the General Secretary urged the participants to deliver a guidance to assist in the implementation of the Cape Town Agreement. Political efforts have intensified to reach the decisive criteria for an early entry into force of the Agreement before the UN Ocean Conference (June 2025). The guidance would be helpful in encouraging more ratifications and guiding early implementation if any Member State wishes so. This may unlock the ratification process of the long-awaited Torremolinos Convention concerning the safety of fishing vessels (adopted in 1977). By pushing forward on this emblematic item, the III 10 only progressed on many other topics.

8moUnfortunately, IMO is strictly constrained by the fact that it can do very little about the problems of domestic shipping, particularly in developing countries, because UN rules preclude its "interfering in the domestic affairs of independent sovereign countries"..It is to be hoped that the new SG can do something about that.
