🌍 Championing Climate Justice: My Take on Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce The upcoming Supreme Court cases, Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce, carry profound significance as they challenge the Chevron deference, a principle allowing federal agencies flexibility in enacting regulations when laws are unclear. The Issue: Scheduled for January 17, 2024, these cases contest a federal regulation requiring fishing vessels to cover costs for compliance observers. The plaintiffs aim to overturn the Chevron deference, established in 1984, which could impact federal agencies' ability to regulate in the face of ambiguous congressional laws. Why I Care: As someone deeply invested in climate equity, I recognize that undermining Chevron deference jeopardizes the government's ability to protect communities from modern dangers, perpetuating environmental injustice. Key Insights: - Originating during the Reagan administration, Chevron deference grants federal agencies latitude in ambiguous legal scenarios. - Conservative justices express skepticism, hinting at a potential reevaluation of the Chevron standard. - Overturning Chevron may hinder federal agencies from effectively addressing emerging environmental issues. My Stand: I firmly stand in support of the Chevron doctrine. It ensures that federal agencies, equipped with specialized expertise, can make critical decisions in the face of legal ambiguity. This empowers experts to address emerging environmental challenges and foster innovation. Closing Thoughts: The prospect of overturning Chevron deference poses a real threat to climate justice and equity. I am resolute in advocating for a legal framework that empowers federal agencies to protect communities disproportionately affected by climate change. Let's work towards a regulatory environment that fosters innovation for the benefit of all citizens, particularly those in Black and Brown communities. This is probably the second time I’ve heard Seth talk about the pivotal moment in his life where he decided to have an even greater impact. How do you show up? How you are thought of? How you are remembered? Ask yourself these questions, not in a narcissistic manner but more along the lines of helping others. Other advice: 1. “DROP THE EGO!” - you can be competitive without being a jerk. 2. “Make a decision” 3. “Book recommendations” - pick an operating system and crush it!
