In the Supreme Court’s ruling in Axon Enterprises vs. FTC, the Court ruled that when a federal agency’s action against a regulated person or entity is so unauthorized and abusive that the proceeding itself is the injury, you have a right to go into federal court and sue the agency to block the proceeding. Balch’s Pepper Crutcher explains this in a new video produced by the Mississippi Manufacturers Association, explaining how the ruling enables companies to take federal agencies to court when they believe agency actions violate regulations, federal laws, or the U.S. Constitution. They are not limited to waiting for a bad outcome before appealing. Pepper is a partner in Balch’s Jackson office and General Counsel to the Mississippi Manufacturers Association. He advises and advocates for a wide range of Southeast U.S., private sector employers. #BalchLeads #MMA
