Dear #Employer, 🔥 Breaking News: The FTC’s non-compete ban, originally set to take effect on September 4th, has been permanently blocked by a federal district court in Texas. What does this mean for you? For now, your existing non-compete agreements remain enforceable. The court determined that the FTC lacks the authority to issue such a rule and deemed the rule arbitrary and capricious. However, the FTC is expected to appeal this decision. The appellate court will eventually determine whether to uphold or overturn the federal district court's ruling. This afternoon, Judge Brown of the Northern District of Texas issued an injunction prohibiting enforcement of the FTC's Final Rule on Non-Competes. The nationwide injunction prevents the rule from taking effect in September, at least for now, with the Court ruling in relevant part that "the text and the structure of the FTC Act reveal the FTC lacks substantive rulemaking authority with respect to unfair methods of competition" and that the FTC "has exceeded its statutory authority in promulgating the noncompete rule, and thus plaintiffs are likely to succeed on the merits." A copy of the Opinion is below and more analysis to come.
