♦♦A GAME OF "DID YOU KNOW" H-1B EDITION 👋 Did you know .... 👀 ⭕The H-1B category has only been around since 1990 (!!). ⭕ The cap wasn't always set at 65,000 plus 20,000 additional for US masters or higher students. In fact, from 2001-2003, the government allowed for 195,000 visas to be issued each year. ⭕ Since the H-1B Visa Reform Act of 2004, the cap was officially reset to 65,000 visa numbers and established an additional of 20,000 additional visa numbers for applicants with U.S. master’s degrees or higher. ⭕Last year the H-1B lottery accepted over 788,000 registrations....for 85,000 visa numbers. We've got a MASSIVE problem here folks, one that this year's modernization of the H-1B registration process is not going to fix. Not even close. ⭕ Congress has tried to pass new legislation or amend existing legislation several times since 2004, but to no avail. We so desperately need the change, but why would Congress change the system when it is already *so* good at doing nothing!?!?😂 Anyways....the countdown to March 6 is on. Dear F-1 Students Graduating in June 2024, Congratulations on starting your last semester of college or university! Many of you will most likely receive OPT for one year, and if you are a STEM graduate, for 3 years. If you plan on working in the US after your OPT expires, now is the time to start planning your immigration future. If you wait until you haven’t been selected in the H-1B lottery and have only 6 months of OPT left, it may be too late. Given the abysmal chances of being selected in the H-1B lottery, it is in your best interest to look at alternatives to the H-1B visa, such as the O-1, E-3, or TN, etc. Know your options so that you can make the best choices for your future in the US. What if my student visa OPT status expires before October 1, 2024? If your registration is selected in the lottery and you file an H-1B petition before the expiration of your OPT, your OPT status is automatically extended until Oct. 1 as a matter of law. This is called “Cap-Gap” protection. Also USCIS has proposed changes to this rule to extend the gap coverage even beyond October 1, 2024 for those petitions that take longer to be approved. This change is not in effect now and only a proposal as of today. #H-1b #immigrationattorney

🍀 What's Luck Got to do with It? 🍀 It's that time of year again - H-1B cap registrations are flooding in before the March 22nd deadline. One question on everyone's mind is whether submitting earlier leads to a greater chance of being selected in the lottery. Hint: It doesn't! Interestingly, the Bachelor's cap started out at 65,000 in the 1990s, rose to 195,000 during the "dot com" boom, sunsetted in FY2004, and reverted back to 65,000. We now have 58,200 Bachelor's cap H-1Bs and 20,000 Master's cap H-1Bs. With possibly 200,000-300,000 registrations likely to be submitted during this registration period, the odds are not in our favor. The math isn't necessarily on our side! ➗ Some key things to remember: 📆 Submit your registration by March 22nd at 9:00 a.m. Pacific time/Noon Eastern time to be included in the lottery. 🤞 The H-1B cap lottery is just that - a lottery. You may only be considered once in the random computer-generated lottery, unless you have an advanced degree from a U.S. university or college. 🙏 It's always best to prepare for the worst and hope for the best. Discuss alternatives to the H-1B (i.e. O-1, TN, E-3, transfer abroad, etc.) if needed. 🍀 🍻 With St. Patrick's Day around the corner, let's hope some good luck comes our way. Cap-gap reminders for students on F-1 F-1 students who are not eligible for a cap-gap extension and facing authorized stay expiration before Oct. 1, 2024 must exit the US. These students may have to leave the United States to avoid potential complications. They can re-enter by securing an H-1B visa at a consular post abroad, if applicable, and seek to re-enter into the United States pursuant to H-1B status based on the approved H-1B petition and visa. The cap-gap rule pertains to cap-subject H-1B petition beneficiaries (counted towards H-1B lottery for Fiscal Year 2025 / in the year 2024), not cap-exempt ones. Important Note 🚨: F-1 students are generally admitted with 'duration of status (D/S)', this i-94 Lawful Record of Admission may prevent them from accruing unlawful presence 🗓️ but not from violation of status ⏳. #F1Visa #H1BVisa #ImmigrationLaw #capexemptH1B #capgap #unlawfulpresence #violationofstatus
