I firmly believe that arbitration is the way to go in terms of alternative dispute settlements for businesses in China. Swiftness, confidentiality, and business acumen of arbitrators are three main advantages often cited as the reasons of the expansion of arbitral awards in Chinese commercial litigation. To reflect these, China International Economic and Trade Arbitration Commission (CIETAC) has released a brand-new set of Arbitration rules, that came into force this year. This is the 10th version since CIETAC’s establishment, showing the adaptability of arbitration rules to the evolving practices, experience, and business environment. While updating the previous provisions, the 2024 rules are embodying the latest developments in terms of international arbitration, such as early dismissal or the rise of digitalisation, to name a few. Common Law Gateway to the Middle East Markets   Mr Nick Chan, MH, JP, Director of the AALCO Hong Kong Regional Arbitration Centre recently visited the Middle East as part of a strong delegation led by the Secretary for Justice to explore new opportunities, build friendships and mutual trust as we meet leaders in the business, financial, disputes resolution and diplomatic communities, and promote Hong Kong as the “common law gateway” and super-connector between the Middle East and the East. Due to some “push factors” and “defocus” from the West, and due to “pull factors” from positive developments in the Cooperation Council for the Arab States of the Gulf and mending of ties between some traditional rivalries in the region with help from “neutral assurer” China, the Middle East is “ready, willing and able” to move more quickly to collaborate with, and realize more opportunities with, the “Global South” and the East, and in particular, China, and the Hong Kong SAR as the gateway. 📝Commercial parties are increasingly turning to the English court for anti-suit injunctions (ASIs) to protect their arbitration agreements when they find themselves defending court proceedings in Russia in breach of contract. Recently, a final ASI was issued against RusChemAlliance (RCA) in favour of Bayerische Landesbank and another bank. And, also what are the limits of international judicial comity alllowing courts to grant anti-suit injunction in support of foreign stated arbitrations? Unicredit Bank GmBH (Respondent) v RusChemAlliance LLC (Appelant) UKSC 2024/0015 Are the courts of England and Wales the proper place for UniCredit to bring its claim for anti-suit injunction against RusChemAlliance, or should the claim have been brought in France ?
