In consular advocacy, it can be important to raise your client's issues to the leadership at a post. Contacting post leadership can help to resolve tricky issues, raise prior processing concerns, and help get expedited appointments when necessary. We've started tracking leadership changes in the visa-relevant positions and we'll be launching this feature soon.

Just in time for today’s start of the pilot program for the domestic renewal of H-1B visas: DOS publishes extensive related FAM guidance to Consular Officers.   Much of the guidance relates to cases that do not qualify for domestic renewal and may thus generate INA 221(g) refusals: (1) the applicant is found ineligible for a waiver of the in-person interview requirement, one of the key requirements of the program; (2) application screening reveals derogatory information pertinent to visa eligibility; and (3) preliminary review gives rise to a suspicion that the applicant’s activities have not, or may not, conform with what is permissible in H-1B status.   Hopes and prayers for a successful pilot program, which runs through April 1, 2024. The last time nonimmigrant work visas were reissued domestically George W. In two weeks’ time the authorization granted to Consular Officers to waive certain in-person visa interviews is set to expire. Among those benefiting from the current authorization are citizens of Visa Waiver Program participating countries who are first-time applicants for some of the most common forms of temporary U.S. work visas:   ·        Persons in Specialty Occupations (H-1B visas) ·        Intracompany Transferees (L visas) ·        Individuals with Extraordinary Ability or Achievement (O visas) ·        Athletes, Artists, and Entertainers (P visas)   In order to qualify for the interview waiver, these applicants must meet certain conditions such as no prior ESTA denials, and previous travel to the United States on ESTA.   The authorization to waive interviews for these applicants was granted until December 31, 2023. The resulting interview waivers have been a huge success in facilitating the travel of foreign temporary work visa holders to the United States, and in reducing visa appointment wait times for other applicants.
