In accordance with the 9-27-2023 Army/EPA Memoranda regarding the U.S. Army Corps of Engineers (Corps), and U.S. Environmental Protection Agency (EPA) Coordination, another joint policy memorandum (LRB-2023-00451) regarding draft approved jurisdictional determinations (think wetland delineation agency concurrence requests) has been issued. This is the tenth joint policy memo that has been issued by the agencies since wetland/waters mapping rules changed on 9-8-2023. The joint memorandum (LRB-2023-00451) addresses factors regarding when certain aquatic features can meet the "continuous surface connection" requirement. The memo explains how the Corps and EPA will work together to determine which waters are protected under the Clean Water Act. What does this mean? For developers and infrastructure projects, this means that obtaining approvals for projects involving water bodies may involve more detailed and coordinated reviews by both agencies. This could impact project timelines and requirements, as the agencies ensure compliance with the latest legal standards. The focus for delineation and regulatory permitting work nowadays: surface connections and documenting the "weight of the evidence" regarding findings. #Wetlands #CWA #Makeadifference #Ichosethiscareer?!

Water Protectors! Enbridge Line 5 crude oil pipeline runs through the largest body of fresh water in the world. It not only threatens the #GreatLakes, but locks in decades of #emissions, disrespects tribal sovereignty, and scams U.S. and tribal citizens into a really bad deal with a very bad company. USACE is soliciting feedback on its Draft Environmental Justice Strategic Plan vision, goals, and objectives. USACE is also soliciting input on priority actions and performance metrics that will be evaluated to advance the plan vision, goals, and objectives.
