🏗️ What drives the ROI on export controls compliance? 🎧Check out our latest pod with Thomas Fox, the Voice of Compliance, below. 👨🏫 Brent Carlson and I had the pleasure of discussing with Tom the trendlines of what we're seeing in U.S. export controls enforcement and compliance, and what companies can do not only to get ahead but to properly evaluate the return on investments in compliance. 📜 Why is this on a U.S. Foreign Corrupt Practices Act pod? Becuase what we have seen parallels the early days of the current FCPA enforcment environment: foreign policy-driven enforcement, the "high probability" standard, prosecutorial common law set by ageny guidance and non-adjudicated settlements, and warning signs of increased corporate enforcement. ⚽️🏀🏈⚾️ The FCPA enforcement playbook, while increasing dramatically the costs of non-compliance, presents opportunities for companies who apply a corresponding, risk-based compliance playbook. Rather than argue over whether bribery was bad or ever possible to stop, companies who saw success under this compliance playbook recognized the new enforcement paradigm and embraced the "high probability" standard to develop defensible and effective due diligence programs to mitigate FCPA compliance and enforcement risk. 👮 Today's AI difussion interim final rule shows that the U.S. government is unsympathetic to challenges to its overall approach on export controls.
