💻In this month's Lawyers Professional Liability (LPL) Tip of the Month, brought to us by our Risk Management partners Hinshaw & Culbertson LLP, we discuss confidentiality considerations when a lawyer posts to listervs. ✅ A recently released Formal Opinion 511 by the ABA concluded that Rule 1.6 of the ABA Model Rules of Professional Conduct does not allow a lawyer to post information in the form of comments or a question relating to representation to a listserv, even if it is in hypothetical form, without having the client’s informed consent if there is a reasonable likelihood that the lawyer’s post will reveal the identity of the client or the matter.
