In response to passage of the FAA Reauthorization Act of 2024 by the Senate, National Air Carrier Association President and CEO George Novak issued the following statement: NACA congratulates Senate Commerce Committee Chair Maria Cantwell (D-Wash.) and Ranking Member Ted Cruz (R-Texas), House Transportation and Infrastructure Committee Chair Sam Graves (R-Mo.) and Ranking Member Rick Larsen (D-Wash.), for working on a bipartisan basis to enact The FAA Reauthorization Act of 2024, a five-year bill to reauthorize the FAA and NTSB. This timely, sweeping legislation will ensure that the U.S. continues to maintain the safest, most efficient airspace system in the world. We are especially grateful that many NACA priorities were addressed in the bill, including: (1) modernizing pilot training programs to increase pilot supply and enhance pilot performance; (2) refraining from imposing new or higher taxes and fees on passengers; (3) addressing the shortage of air traffic controllers at major ATC facilities in Florida; (4) authorizing more funding and resources for the NTSB; and (5) protecting air service to small and rural communities. We commend the Senate for passing the bill last night with strong bipartisan support and urge the House to follow suit next week. #aviation #aviationsafety #airtrafficcontrol #airtrafficmanagement #pilottraining https://lnkd.in/g4gShfMP

Senator Maria Cantwell is calling on #Boeing to testify about the FAA’s oversight failures. But this raises a crucial question: Why ask Boeing? The real scrutiny should be on the FAA. They trusted Boeing to police itself, despite not having the funds for proper oversight. It’s like driving slightly over the speed limit when no one’s watching – things get sloppy without proper monitoring. My testimony would be that the FAA dropped the ball because Congress failed to appropriate the necessary funds for correct staffing. To ensure our skies are safe, the FAA needs the resources, especially since these funds come from taxes paid by passengers who expect safety. “Why Ask Boeing? Interesting to see the learning period in 51 U.S.C. § 50905(c)(9) is extended only to January 1, 2025 in the FAA Re-authorization. Perhaps kicking it down the road to the 119th Congress or perhaps hoping H.R. 6131 passes before the end of the 118th. Interesting times coming. #spacelaw #faa #regulation

We just passed the chronological midpoint between the DoT's preliminary ruling (1/26/24) and the effective day of the potential termination of the AM/DL JCA (10/26/24). As the DoT's sounds of silence grow louder by the day and for some the nail-biting becomes more intense, I continue to be frequently approached to crystal-ball my expected outcome. From my vantage point, to recap my past views on the matter, I offer the following variables that ought to be factored into this complex matter: 1. Key provisions of the 2015 bilateral Air Services Agreement (ASA) are no longer in place, essentially due to decisions made and implemented by Mexico. 2. AA and UA have sided with DoTs position, just as DL and G4 have opposed it. DL has actually threatened to take legal action against its own government. 3. Mexico's relevant officials are de facto lame ducks and would rather inherit the matter to the new administration coming in on 1/10/24. This is barely three weeks ahead of the purported AM/DL JCA sunset. 4. It might be, hypothetically at least, that a potentially weakened AM might serve the interests of other parties. The above would seem to suggest the DoT ruling will stand. I am nevertheless of the opinion the DoT will also kick the can to the next administration coming in on 1/20/25, by possibly giving a six month grace period to AM/DL and keeping the G4/VB joint venture application in the freezer. I also anticipate a less tolerant US regulatory position towards Mexico from 2025, if not earlier, which will in all probability formally denounce violations to the ASA. Last week, DOT OIG released the report of its audit of FAA’s oversight of the use of aviation fuel tax revenues. The Airport and Airway Improvement Act of 1982 limits the purposes to which these funds may be put. Our audit made three recommendations, including that FAA establish a plan of action to bring California, Kentucky, Nevada, Tennessee, and Guam into compliance with the requirements for use of these revenues.
