Sunday Morning Bathroom Read (1st Gag Clause Violation of 2024 Edition): Section 2.2 of the attached addendum (effective 1/1/24) to the BCBSTX ASO Agreement provides in pertinent part: " ... Employer agrees that any services in connection with the Plan... its vendor ( i.e. "everybody": PBM, TPA, Broker, Stop Loss, Nurse Deb, entire enchilada ... ) shall not engage with or contact any provider except as permitted by the Claim Administrator... " General Observations: A) BCBSTX's "real" customer is its provider network. The Plan sponsor is simply grist for the mill and its employees are wage slaves to BCBSTX; B) More importantly, what assurances did BCBSTX make to its contracted providers? Bill with impunity? Plunder and pillage with a hall pass? The details are in the Participating Provider Agreement; C) The "gag clause" violation market is ALL downstream with the "vendors."

Great angle here! I want to point out that there are some great DME reps out there in the trenches with the Acentus sales team. There are also quite a few bad actors that are only looking to grab a patient based on social media or radio/TV ad marketing. To be the best provider possible, Acentus has chosen to stay in a very niche lane with Medicare (Red, white, and blue card), and with that comes speed and specialization with Medicare patients. Knowing that certain insurances are better suited for my competitors, I’ve gone as far as building relationships with other reps from other companies. Offering a network of doctors is one type of service. Offering insurance that pays that network of doctors is a separate type of service. Being a TPA is a third type of service. What happens when the company offering you a doctor network is ALSO the company providing you insurance for the charges made by that doctor network and is ALSO the TPA? They can easily con your HR into signing a contract like this so you lose all ability to control your costs while your broker stands by collecting checks.

Well worth reading - cover the risk of shortfalls for in-hospital procedures due to service providers charging above medical aid rates, co-payments and sub-limits. Is it really worth taking a chance ?
💸 In 2023, three mega gap claims alone paid by Sirago Underwriting Managers came to a staggering R440k in shortfalls for in-hospital treatments not covered by medical schemes. Of the R958k in specialist charges for these three claims, medical schemes only paid out 46% of the total specialist bills, while gap cover stepped in to pick up the 54% shortfall! 💉💰 When gap cover was first introduced as a financial solution to medical scheme shortfalls, gap claims averaged between R6 000 to R12 000.
