I wrote previously on the civil fraud case involving the same individuals for the enforcement of a US judgment. This new development is the criminal proceeding in Massachusetts for penalties and for monetary restitution. Among other noteworthy aspects of this significant development is the emphasis on individual decisionmakers, a theme the CFPB Director has emphasized previously. The “how” of their supervision and enforcement approaches ( and interpretations) will be important to monitor. Boards and senior execs now more than ever need to have a solid understanding of key aspects of their CMS such as change management, risk identification, complaint analysis, and issue management, topics that will be discussed by a variety of experts and practitioners next week in Seattle at #ABARCC.
Too often, companies see fines and penalties as the cost of doing business. Today, the Consumer Financial Protection Bureau issued a rule to help detect and deter repeat offenders. Breaking the law shouldn’t be more profitable than following it. The new registry will help law enforcement stop repeat offenders before they can further profit from fraud.

We often see media reports raising awareness of scams, fraud, and financial crimes committed by organised criminals, often offshore. However, what is less commonly reported is the insidious and devastating impact of inheritance impatience (also known as theft) and elder financial abuse, perpetrated by 'trusted' family members and associates acting as an Enduring Power of Attorney (EPOA) or Power of Attorney (POA). This article by Duncan Hughes in The Australian Financial Review serves as a timely reminder about the importance of seeking independent legal advice on complex legal and financial issues such as powers of attorney. It also highlights why banks are placing such a focus on continuing to develop approaches to preventing, identifying, and responding to this issue - including support for nationally consistent laws.

Elder Financial abuse: Getting a criminal conviction for elder financial abuse is so significant. Usually the police consider it a civil matter and do not pursue it criminally. World Elder Abuse Awareness Day was last Saturday, June 15. Unfortunately, approximately 60% of abusers are family members closest to the victim. At Malecki Law, we have seen an uptick in financial abuse cases involving family members.
