Employers be aware! Facially neutral policies may not be enough - particularly where you have an employee who has previously engaged in concerted activities. A strong relationship with experienced employment counsel will help you navigate these tricky situations before they turn into front-page news.

Under the NLRA, workers have the right to engage in concerted activities with fellow employees. Home Depot sought to limit the display of what it called “controversial” messages by employees, but the NLRB deemed it to be a "logical outgrowth" of prior concerted activity and protected by the act.

Happy Labor Day! When labor day started in 1894. It was celebrated as a non-national holiday earlier than that and the very first Labor Day was created by unions striking. At the time, in 1890, the average manufacturing worker toiled in a factory 60 hours a week. This was down from the average of 70 in the 1830s. Some of you are reading that in shock, if you've ever worked a farm you aren't. I wrote about Work/Life integration last week. This is part of that. Labor Day is no longer about trade unions and extremely long hours (seems that fight was won long ago). If you do happen to work all the time, use this as an opportunity to take some time and enjoy the fruits of your labor. I try and practice this with my team where during our quarterly planning we review everything we accomplished in the previous quarter before looking to the new one. This is necessary if you're like me and the tendency is to always look at what's not done. It's healthy to look back and celebrate the ground taken. You work hard. Take a break, look around, enjoy the results of your work.

🛠️ LABOR DAY 🇺🇸 ℹ️ Labor Day has deep roots in the 130 years of the labor movement and its efforts to improve working conditions in America. It is also known as International Workers’ Day or May Day and is celebrated on May 1 internationally 📌 With the growth of the Industrial Revolution came the demand for labor and trade unions. Around the 1850s, eight-hour movements across the world aimed to reduce the working day from ten to eight hours. At its first Congress in 1886, the American Federation of Labour called for a general strike in Chicago on May 1 to demand an eight-hour day, which culminated in what is known today as the Haymarket affair #laborday #america #letscelebrate

Have you ever wondered if there was a better solution to unions? Not just siding with unions are needed / good or unions are evil and force corporations to keep bad workers. There are arguments on both side for and against unions. But, what I want to know is .. Is there a better solution than unions? .. How about this idea .. Start a company or series of companies that solely focuses on hiring and placing baristas and bar tenders around a city. These companies would act like recruiting companies, and provide benefits that coffee shops and bars could not. In turn their employees all get group health care, sick days, have a larger pool to pull from when replacements are needed, and so forth. This company isn't a union, but to have enough pull as both a lobbying firm and a bargaining firm, they would need to hold a percentage of the work force in reserve to influence the market place.
