UPDATED CSCB GENERAL AGENCY AGREEMENT (GAA) AND STANDARD TRADING CONDITIONS (STC) NOW AVAILABLE In case you missed it, the CSCB’s updated General Agency Agreement (GAA) and Standard Trading Conditions (STC) documentation are now available. The GAA document has been modified to incorporate references to CARM, to reflect updated customs and trade terminology, and to address the new (but not yet in force) amendments to the Customs Act that extend liability for duties and taxes to the Importer of Record (IOR). CSCB staff and legal counsel will offer webinars in early 2024 to walk through the updated documents to ensure Members understand how to best protect themselves against new liability risks posed by the implementation of CARM and the IOR amendments. #CBSA #customscompliance #GAA #CARM #export #import

MoU between the FSCA & the BBBEE Commission. What does this mean moving forward? In summary: FSCA: Primarily responsible for regulating market conduct within the financial sector, including adherence to B-BBEE standards. The FSCA commits to integrating B-BBEE considerations into its regulatory frameworks and policies. B-BBEE Commission: Focuses on monitoring and enforcing compliance with B-BBEE legislation, as well as promoting understanding and implementation of B-BBEE measures. On 1st July 2024, International Chambers of Commerce unveiled a new digital trade tool that aims to simplify self declaration process of goods for exporters operating under free trade agreements (FTAs). Traditionally, the exporters must self certify the origin of their goods adhering to the rules of origin. This procedure, a rather simple yet complicated process results in mistakes, cases of fraud and fuels the sense of doubt in importers for goods being imported by SMEs especially. Why does this happen? Often due to lack of knowledge, lack of automation, miscommunication etc. To counter this issue of simple documentation and verification, ICC genesis aims to digitize this procedure of self certification for exporters while providing them clear information and steps on how to complete the procedure. A rather simple automated solution will not only reduce errors and miscommunication but also allow local manufacturers and SMEs of different regions to participate in global trade without complicated procedures and having incomplete information. We are proud to announce the release of the Overcoming Legal and Regulatory Barriers to eBL Adoption report.   This report contains extensive research carried out in 15 countries, representing 60% of global trade. The purpose of the report is to identify the legal and regulatory barriers to the global supply chain’s goal of achieving 100% electronic bill of lading (eBL) adoption by 2030. It provides specific recommendations for legislators and governments on how to overcome these barriers in order to accelerate digitalisation across global trade.
