On February 5, 2024, the EPA Administrator signed a Final Rule regarding the “Reconsideration of the National Ambient Air Quality Standards for Particulate Matter”. This rule will reduce the PM2.5 NAAQS from the current value of 12 micrograms/cubic meter to 9 micrograms/cubic meter. The Federal government has promised to address the uncertainty facing major Canadian projects like ports, airports, pipelines, roads, transmission lines, natural resource developments and manufacturing and has proposed some draft amendments to the Impact Assessment Act. Brad Gilmour, Co-Chair, of Environmental Disputes and Enforcement at Osler and Charles DeLand, associate director of research at the C.D. Howe Institute argue in their recent op-ed that the fixes proposed by the government will not help to speed up projects and will lead to further litigation and investment uncertainty. The recording of the Airminers mCDR panel on permitting and siting is live! Key takeaways: - The US regulatory space is lacking some clarity on jurisdiction for mCDR permitting, but that does not prevent pilots and small scale deployments from occurring. There ARE avenues, but the landscape is complex. More is sure to come from the EPA, newly formed Fast Track Action Committee, BOEM, etc. - We can learn a LOT from each other as startups pave their own pathways in the space. Sharing knowledge and experiences, and collaboration is invaluable in accelerating the field. - A variety of stakeholders need to be engaged with: towns, states, federal governments, fishing, sovereign indigenous nations, civilians. The sooner community engagement happens the better. - Regulatory bodies, communities, and academic institutions should be viewed as partner, not obstacles. A big thank you to AirMiners and Jason Grillo for hosting and facilitating.
