New decision from the Court of Justice of the European Union on air passenger rights in the case Touristic Aviation Services v FlightRight GmbH (C-405/23). The CJEU held that the shortage of airport staff for loading baggage which caused a long delay of a flight may constitute an “exceptional circumstance”. Article 5(3) of Regulation EC 261 must be interpreted in the sense that the fact that the airport operator's staff responsible for loading baggage onto aircraft is insufficient is likely to constitute an “extraordinary circumstance” within the meaning of this provision. New decision from the Court of Justice of the European Union on air passenger rights in the case Cobult UG v TAP Air Portugal SA (C‑76/23). The Court held that Article 7(3) of Regulation (EC) No 261/2004 must be interpreted as meaning that, in the event of cancellation of a flight by the operating air carrier, the passenger is deemed to have given their ‘signed agreement’ to reimbursement of the cost of the ticket by a travel voucher where they filled in an online form on the website of that air carrier, by which they chose such a means of reimbursement to the exclusion of reimbursement by a sum of money, where that passenger has been able to make an effective and informed choice and, accordingly, to give informed consent to the reimbursement of the cost of their ticket by a travel voucher rather than by a sum of money, which presupposes that that air carrier has provided to that passenger, in a fair manner, clear and full information as to the various means of reimbursement available to them. #aviation #airlines #airtransport #flightdelay #flightcancellation #flightcompensation #passengerrights #ec261 #aviationlaw #airlaw

If traffic shifts from Dulles International Airport (IAD) to Reagan National Airport (DCA), airlines would cut international routes, which largely rely on domestic connections for their transfer passengers. It would also discourage airlines from starting new international routes at IAD. Recent Rulings by the Court of Justice of the European Union in Cases C-474/22 (Laudamotion - Decision not to take a delayed flight) and C-54/23 (Laudamotion and Ryanair): The Court has clarified that passengers who opted not to board a flight experiencing a considerable delay or those who purchased tickets for alternative flights and reached their destination with a delay of less than three hours, are not eligible for fixed compensation. Our priorities for the new Government: #3 Air Cargo Problem: There has been a sudden and dramatic loss of slots for cargo-only flights at Heathrow and other airports in the Southeast. Suitable capacity at airports outside the Southeast is insufficient and means more freight travelling greater distances by road. Supply chains have been disrupted, exposing the UK’s strategic vulnerability and competitive weakness. Solution: Take urgent action to create a protected pool of slots for cargo-only flights in the national strategic interest, giving businesses the certainty they need. Accelerate reform of how slots are allocated, with strengthened regulatory oversight by the Civil Aviation Authority. Over the longer-term, deliver extra capacity through airspace modernization and supporting investment in new airport infrastructure. #aviation #groundhandling #aircargo
