At the IP Dealmakers conference in London today I had the honor to be on a panel moderated by Robin Jacob with fellow panelists Tom Mavrakakis and Patrick McCutcheon. With respect to the EU SEP Regulation I explained that it's not plausible that every single defendant to a German SEP case over the last 4 or 5 years with only one exception due to double-dipping by overlapping patent pools has been deemed an unwilling licensee. Unwilling licensees will be somewhat overrepresented among those who get sued, but they can't all be unwilling. That said, the EU SEP Regulation does not solve that problem. It creates delay and encourages other jurisdictions to complicate enforcement, but it doesn't address some of the excesses of German case law. In my opinion, Sisvel v. Haier must be overruled because it's intellectually dishonest, and there must be some proportionality when a single patent is infringed and the patent holder fails to make a bilateral licensing offer.
