I wrote a case summary for the INTA Bulletin on the Belgian 'Exforge' case. The case concerns the practice of parallel importers rebranding generics as the reference product and the conditions under which this is permitted or constitutes trademark infringement. This is an interesting issue which has given rise to a preliminary ruling by the European Court of Justice (Impexeco and PI Pharma v Novartis, Joined Cases C-253/20 and C-254/20) and has kept the Brussels courts busy recently. I have also learnt that the Brussels Court of Appeal has recently delivered its judgment in a similar case involving the reference medicine 'Rilatine'.
