You know I love to spread the word on preparation for mediation! Please prepare for mediations. Please give yourself time to prepare. Please ask the mediator well in advance for any tips on preparing. Please read my posts on preparation. Please ask colleagues how to prepare if it’s your first mediation. Please spend time with your clients in advance of the mediation. Please prepare them for settlement conversations. Please send enough information to the mediator well in advance. Please don’t leave it until the evening before or dare I say it, the morning of, the mediation for any information to be provided to the mediator. Please don’t say you disagree with a value on the day of the mediation but have done nothing to get another valuation. FINALLY please don’t get angry when the mediator says it’s time to go home, when you finally feel prepared 12 hours in but everyone else has long gone in terms of the negotiation. I don’t have the magic wand to keep people engaged forever and a day. It takes the right preparation to help me with that! So please prepare! Happy Monday! #mediation #unlockhorns #ADR #ODR
