Following a series of legal challenges, Hadef & Partners successfully obtained a final judgment nullifying a Sale & Purchase Agreement (SPA) and securing the recovery of AED 114 million for its client. The case was litigated before the Court of First Instance, Court of Appeal, and Court of Cassation, all of which ruled in favor of the client, nullifying the contract and ordering the seller to return the AED 114 million, plus interest from the date the case was filed. However, enforcement was obstructed when the seller transferred ownership of the property to a quasi-governmental entity, creating a legal hurdle. The firm initiated proceedings to declare the transfer ineffective under Article 397 of the Federal Civil Transactions Law but initially faced jurisdictional challenges. A later directive restored court jurisdiction, allowing the case to proceed. Although the defendants argued the claim was time-barred, a landmark decision by the Dubai Cassation Court General Assembly confirmed that filing a lawsuit interrupts the limitation period. As a result, Hadef & Partners overturned the prior dismissal, secured a new judgment, and resumed enforcement, with the property now set for public auction. This case highlights the firm's legal expertise and persistence in overcoming complex procedural obstacles to achieve justice for its client. Discussion Invitation: Do you agree, based on your legal opinion, with the Court of Cassation's ruling regarding how the value of a case is assessed to determine whether an appeal can be filed? In a recent ruling by the Court of Cassation in Dubai, a new legal principle was adopted that raised significant legal questions about how the value of a case should be assessed to determine whether it meets the threshold for an appeal, whether before the Court of Appeal or the Court of Cassation. The ruling stated that in cases with multiple plaintiffs, despite having a common legal cause for their claims, the value of each plaintiff’s claim should be considered separately. Even if the legal cause is the same, the total value of the claims cannot be aggregated to meet the appeal threshold. Here is the legal text on which the ruling was based: "If the claims in the case arise from a single legal cause, the total value of the case is considered by adding the value of all the claims... However, if there are multiple plaintiffs, and each has a separate claim, the value of each plaintiff’s claim will be assessed based on the monetary value of their individual request, without considering the combined value of the other plaintiffs' claims." Analysis of the Ruling: This judgment marks a shift in legal reasoning. I have not found previous rulings that assessed the value of claims separately when there are multiple plaintiffs. Earlier rulings tended to aggregate the value of all the claims in such cases. The key question is: Does this shift represent an evolution in the application of the law, or could it complicate legal procedures? What impact might it have on future cases? Personal Opinion: I believe this judgment could signal an important development in how courts handle complex cases. However, it might raise questions about its consistency with established judicial principles that the Court of Cassation has followed in similar cases.
