The majority of law firms have now withdrawn from Legal Aid work altogether as it is no longer financially viable. The long-term result of these cuts has been to remove access to justice for millions of people with low incomes. Bretherton Law have been helping and supporting vulnerable individuals and families in Hertfordshire for over 50 years, and we will continue to do so by offering Legal Aid work in Family and Children Law wherever possible. There are children in need of protection, parents who desperately want to raise their children but just need a little extra support, and grandparents who want to give their grandchildren a safe and loving home when their own children have been unable to do so. “The system is in a precarious state and ultimately the ones who will suffer are those trying to seek justice." This is Nick Emmerson speaking out on the news that changes to the legal aid means test have been delayed until 2026. The legal aid means test (which determines someone's eligibility for legal aid) has not been updated in line with inflation since 2009. Since then, prices have risen by 40%. This means fewer people are eligible for legal aid each year and may be unable to access justice. Research by the The Law Society shows that people on incomes below the minimum standard are being excluded from legal aid, meaning families living below the poverty line are failing to meet the extremely restrictive thresholds to get legal aid. Another barrier to getting justice is the value of people’s home being taken into account in the means test assessment, even though they cannot access this money. Civil legal aid providers are questioning their ability to stay in the profession with 40% of providers telling the government that they will actively leave the sector. We see first-hand the challenges that domestic abuse victims-survivors face in accessing legal aid to help them to secure a civil protection order. Legal Aid is disappointed the Supreme Court has decided the Constitution allows governments to make it a criminal violation to be homeless. • In Minnesota, more than 7,000 people were turned away from homeless shelters last year. • People who are homeless often have no choice except to sleep wherever they can. • Even without criminal citations, however, government entities have undertaken needlessly harsh actions toward Minnesotans who have no choice but to sleep outside. Such actions include destroying medicine, keepsakes and the few belongings of families who are homeless—often, without warning. Mid-Minnesota Legal Aid, along with the ACLU of Minnesota and Ballard Spahr LLP has filed a lawsuit that seeks to end those practices. • We are encouraged by the fact that the City of Minneapolis has shown interest in amending its ordinances to treat our neighbors more humanely at such vulnerable moments in their lives. We hope this decision from the U.S. Supreme Court inspires urgency for the City to complete its work, and for other local government entities to follow. • Charging people with crimes who have nowhere else to sleep will not solve the problem. It will not build more shelters or make shelters easier to access. It will not make fewer people homeless. • In fact, criminal charges can exacerbate homelessness. Often people struggle to obtain housing due to criminal records and eviction records. • In Minnesota, prior to this decision most governments have not taken the step of criminalizing homelessness. Yesterday I submitted my evidence to the 'Review of Civil Legal Aid' being run by the UK government. Today I submitted my evidence to the UK Parliament Public Estimates Committee on 'Value for Money from Legal Aid'. Many agencies are trying in a broken, underfunded system. Total redesign needed not miserable patching up. I proffer some alternatives based on an evidence base but also more effective, efficient models in Australia. I drew on my impact evaluation experience about what makes a difference based on lived experience. Hopefully suggestions will be heeded. https://lnkd.in/e2FxpNsG

Cornwall Law Society’s Family Lawyer of the Year 2023. I assist clients who may be going through/have been through a separation, needing advice on Divorce, Finances, Children or Domestic Abuse issues.
Survivors of domestic abuse continue to be robbed of access to justice, as growing numbers are forced to represent themselves in court, says The Law Society. According to the latest family court figures, 29% of survivors represented themselves in 2023, when only 15% did in 2011. Between April and June 2024, 1,555 people made domestic abuse applications without legal representation. In total, there were 7,720 domestic violence applications made in that quarter. This number has almost doubled since 2011. Law Society of England and Wales president Nick Emmerson said: “Although legal aid is still available for cases involving domestic abuse, recent figures show an alarming number of survivors being left to represent themselves. We are all entitled to a life free from violence and fear and where our children can thrive. Investment in the justice system and legal aid would secure a vital public service and ensure that support and protection is there when needed. Our research shows 19% of legal aid firms have closed in the last five years. This means that domestic abuse survivors who are eligible for legal aid struggle to find a provider in their area. Unable to afford representation, many are forced to appear in court on their own, navigating complex court processes and procedures to seek protection for themselves and their children. The UK government’s failure to expand the legal aid means test has also meant that people living in poverty are unable to meet the income threshold. We must expand the means test and invest in legal aid, so that survivors of domestic violence can access the legal help they need. According to the 2023 ABA Profile of the Legal Profession, civil legal aid lawyers are in short supply across the United States. Per the report, even though there are 1.3 million lawyers in the U.S., there are still only 10,000 paid civil legal aid lawyers nationwide.
