📢 Second-Generation Canadians Now Eligible for Citizenship The Honourable Marc Miller, Minister of Immigration, announced that the federal government will not appeal a court ruling declaring part of Canada's Citizenship Act unconstitutional. Miller emphasizes the commitment to ensuring a fair and transparent citizenship process, acknowledging the value of Canadian citizenship globally. 🔍 Court Decision: In December 2023, the Ontario Superior Court found the "second-generation cut-off" rule, denying automatic citizenship to children born abroad if their Canadian parents were also born abroad, to be in violation of Charter rights. 💡 How Did the Rule Work? It prevented foreign-born children of Canadian parents, born abroad, from automatically acquiring Canadian citizenship. Critics argued it created a two-tier citizenship system. 🌍 How Will This Impact Canadians? This decision affects up to 200,000 "Lost Canadians" who were denied citizenship rights due to the "second-generation cut-off." As employers, it is imperative to timely and properly complete Forms 1-9 on all employees at the time of hire, rehire, and revertification. Make sure you are using the most current Form 1-9 by October 31, 2023. Failure to use the current form could result in penalties for your business.
