What role do in-house and outside counsel play in identifying and mitigating a company's litigation risks early on? In our recent virtual session, Helping In-House Counsel Confront Litigation Risks at Very Early Stages, we discussed this. Our panel was a diverse group of in-house and outside counsel: Tracie Bryant, partner at Kirkland & Ellis LLP; Katherine Halliday, Associate General Counsel for General Litigation at Freddie Mac; Hannah Breshin-Otero, Vice President and Deputy General Counsel for CACI International, Inc., and our moderator, Serafina Concannon, Of Counsel, Caplin & Drysdale. Here are a few takeaways from the group: * Be sure to use your outside counsel to help understand if your litigation risk is a "stone" or a "grenade"; * A system for tracking and monitoring complaints and keeping apprised of what is happening with your counterparties in the market can be helpful; * If your company is committed to a diverse, inclusive, and representative team, ensure the outside counsel teams you consider include women and people of color as well; * Communication with clients and responsiveness is key for outside counsel to ensure a positive relationship; * It's important to develop a cohesive narrative and strategy early on because you only get one set of facts, and if you change them, you lose credibility with the judge. #promotingwomenlawyers #inhouse #litigation #professionaldevelopment
