Entered into force on 18 August, this groundbreaking law is the first European-wide legislation of its kind. It sets legally binding targets to restore 20% of the EU’s land and sea areas by 2030 and aims to restore all ecosystems in need by 2050. This regulation is a key component of the European Green Deal and the EU Biodiversity Strategy. By 1 September 2026, Member States are required to submit their national restoration plans, detailing their strategies and monitoring progress. The journey to the law’s adoption was strongly supported by the public and the scientific community. Over one million citizens signed petitions and sent messages in favour of the law. Additionally, more than 6,000 scientists, 100 businesses, youth organizations, and various civil society groups advocated for its passage, demonstrating widespread support across multiple sectors. Addressing these challenges is not only essential for environmental sustainability but also for economic resilience. 𝐃𝐞𝐜𝐫𝐞𝐭𝐨 𝐢𝐧𝐠𝐢𝐮𝐧𝐭𝐢𝐯𝐨: 𝐥𝐚 𝐟𝐚𝐭𝐭𝐮𝐫𝐚 𝐞𝐥𝐞𝐭𝐭𝐫𝐨𝐧𝐢𝐜𝐚 𝐩𝐨𝐭𝐫𝐞𝐛𝐛𝐞 𝐧𝐨𝐧 𝐞𝐬𝐬𝐞𝐫𝐞 𝐩𝐢ù 𝐬𝐮𝐟𝐟𝐢𝐜𝐢𝐞𝐧𝐭𝐞 Generalmente, fino ad oggi, il creditore che voleva ottenere un’ingiunzione di pagamento poteva allegare al proprio ricorso la fattura elettronica emessa in relazione alla prestazione del servizio o alla vendita del bene oggetto del rapporto sottostante la richiesta di ingiunzione. Infatti, secondo consolidata giurisprudenza di merito, “la fattura commerciale è considerata prova idonea al fine dell'emissione del decreto ingiuntivo ai sensi dell'articolo 634 c.p.c.” (tra le molte, Trib. Potenza, 6.11.2019, n. 868) se viene allegata al ricorso unitamente alla prova dell’avvenuta comunicazione sul Sistema di Interscambio. Tuttavia, la Settima Sezione del Tribunale di Roma, con la recentissima ordinanza del 24 settembre 2024, potrebbe irrobustire l’orientamento minoritario che si era già registrato in alcuni Tribunali del nord Italia (fra tutte, v. Trib. Vicenza, 25 ottobre 2019), secondo cui “ un documento formato dalla stessa parte che lo produce non rileva come prova in favore della parte stessa” essendo necessarie “le scritture contabili previste dal codice civile, "purché bollate e vidimate nelle forme di legge e regolarmente tenute", e quelle prescritte dalle leggi tributarie, "quando siano tenute con l'osservanza delle norme stabilite per tali scritture" (Trib. Roma, ordinanza 24.09.24). A questo punto, dunque, deve attendersi il consolidamento dell’uno o dell’altro orientamento in modo da comprendere anche se i soggetti che emettono fatture elettroniche, i quali sono stati esonerati con l’introduzione del Sistema di Interscambio dall'obbligo di annotazione nei registri delle fatture e degli acquisti di cui agli artt. 23 e 25 del d.p.r. n. 633/1972, siano ancora tenuti, in via del tutto illogica, a tenere delle scritture contabili - ai fini dell’emissione di un decreto ingiuntivo - che non hanno però l’obbligo di utilizzare. 🚨 NEWS ALERT 🚨 Lo scorso 4 ottobre è entrato in vigore il D. Lgs. n. 141/2024, che contiene le disposizioni nazionali complementari al codice doganale dell’Unione e la revisione del sistema sanzionatorio in materia di accise. La riforma dà attuazione alla delega fiscale (L. 111/2023), con cui era demandata al legislatore l’armonizzazione della disciplina doganale con quella dell’Unione Europea, telematizzando le procedure e potenziando le attività di controllo. Fra le tante novità, la riforma modifica l’art. 25-sexiesdecies del D. Lgs. 231/2001, prevedendo la responsabilità dell’ente per le fattispecie penali previste: ✔︎ dalle disposizioni nazionali complementari al codice doganale dell'Unione ✔︎ dal Testo Unico Accise (D. Lgs. n. 504/1995) Le Società che hanno adottato il Modello Organizzativo saranno quindi tenute a valutare l’impatto di tali novità, “mappando” il rischio di commissione dei relativi reati e procedendo all’aggiornamento del Modello stesso. Si conferma la centralità della compliance 231 come strumento ormai imprescindibile anche per mitigare i rischi correlati alla gestione delle importazioni, esportazioni e adempimenti doganali. Con la sentenza n. 2024/724 del 10 settembre 2024, resa nella causa C-465/20, la Grande Sezione della Corte di Giustizia dell'Unione Europea ha annullato la sentenza del Tribunale UE relativa ai tax ruling concessi dall'Irlanda a favore del gruppo Apple. La Corte ha così confermato la decisione della Commissione Europea del 2016, stabilendo che l'Irlanda ha concesso al Gruppo Apple un aiuto di Stato illegale, che dovrà quindi essere recuperato.
