Exciting Event on Due Diligence In the Garment & Footwear Sector ! I had the privilege of attending the insightful discussion at the symposium on "The Impact of Business Agreements on Human Rights and Labor in Apparel and Footwear Supply Chains." The event shed light on the crucial role that legally binding agreements, voluntarily entered into by businesses, can play in identifying and addressing risks related to human rights and labor in the apparel and footwear supply chains. Representatives from various sectors, including brands, manufacturers, unions, and government officials, shared valuable insights gained from negotiations and the implementation of existing agreements. The discussions delved into the significance of such agreements, particularly in the context of mandatory due diligence legislation. It was truly enlightening to witness collaboration among diverse stakeholders committed to advancing responsible business practices. The event emphasized the importance of fostering transparency, ethical sourcing, and sustainable practices within the industry. Au-Delà du Cuir announces 2024 intake French industry initiative ADC Au-delà Du Cuir (ADC) has announced the names of the #footwear and accessory brands that will make up its 2024 intake. https://lnkd.in/d7bfrWQX ADC is a joint-initiative of a range of industry organisations in France, with The French Leather Council (le Conseil National du Cuir), the French Footwear Federation and CTC (The French Professional Development Committee for Leather, Footwear, Leather Goods) among the most prominent. Its aim is to encourage French companies to develop manufacturing operations in France, rather than be obliged to produce elsewhere for economic reasons. Companies selected to become part of ADC receive coaching and advice, and help in securing funding to take their companies forward. For 2024, seven companies will join the programme. ADC has named them as: shoe brands Corail, Meeko, Philippe Zorzetto and Virón, plus accessory brands 10.03.53, Bonastre Paris and Fane.

www.resolvoassociates.com Relaxo Footwears Limited vs. Aqualite Industries Pvt Limited, The Plaintiff, India's largest footwear manufacturer, sought an ex-parte injunction against the Defendant. The Plaintiff accused the Defendant of copying its products, designs, trade dress, and overall presentation. The Court examined the matter under Sections 2, 4, 5, 19, and 22 of the Designs Act, 2000, as well as various precedents. It highlighted that simply registering a design does not guarantee protection for the registrant, as the Defendant is allowed to argue lack of novelty or the presence of prior art. The Court outlined the criteria for such cases, stating that the decision should be based on whether the essential features are visually distinct or if the two designs are substantially different. After comparing the products, the Court determined that the Defendant had prima facie copied the Plaintiff’s design. Additionally, the Defendant's claim of the Plaintiff's design lacking originality was undermined by its own application for a similar design registration. The Court decided that the issue of prior art would be addressed after presenting evidence. Dr. Martens has taken a stand against online retailer Temu for trademark infringement. The iconic footwear brand alleges Temu has been using "Dr. Martens" and "Airwair" keywords in Google ads to promote knock-off boots, overshadowing authentic products in search results. With a lawsuit filed at the High Court, Dr. Martens is fighting back against counterfeit practices.
