Illinois mechanics lien law is extraordinarily complex. If a lien claim is not precisely accurate, it can be defeated by property owners, and have little value. The Good Cause Eviction Law does not apply to buildings where a temporary or permanent certificate of occupancy was issued after 1/1/2009. The exemption is good for 30 years from the date of the CO. The plain language of the statute is not just exempting new construction from the law. Building with an iCard (i.e., built prior to 1938) can get a certificate of occupancy and then be exempted from the law for 30 years. Trying to understand the rationale of this exemption? So am I.

Experts do not have a duty to the instructing solicitor(s); they have an overriding duty to the court. This means that, even if a solicitor has instructed an expert to provide evidence which they believe will further their client’s case positively, an expert cannot tailor their findings to state what the solicitor requires. Their opinion must be independent and must only cover areas that are within their expertise. The recent case of Glover and another v Fluid Structural Engineers & Technical Designers Ltd and others [2024] EWHC 1257 (TCC) demonstrates this issue and its potential consequences.
