Yesterday at 11:00 PM, YSSE held the board of directors meeting, a meeting for control implementation, feedback, and standardization. The meeting was delighted by the presence and participation of the YSSE president Sheikh Mohammed Yousuf sir, Directors, Heads, and Assistant-Heads from all the departments. The agenda of the meeting was to change in the regulation of the management, and a new focus on innovation and execution, and increasing the offline activities for the members of YSSE. Moreover, all departments are set into motion and sub-teams are moving forward to achieve the targeted goals. The year brings a new air in the YSSE, an air for innovation and change. What a fabulous session on AI & Governance for the behavioral health sector! Masterminded by none other than a BH rockstar 🤩 Stacy Olsen DiStefano! Thank you Stacy & #ANCORCONNECT24 for inviting me to be a part of this year’s event! The audience was huge! so engaged & awesome! Loved it! 💪🏻 Here is recap of just some of what we discussed: ⚖️ WHAT IS A BH ORG LEGALLY REQUIRED TO COMPLY WITH WHEN EVALUATING AI TOOLS? 1. Privacy & Security. If an AI tool collects ANY kind of identifiable data, orgs need to evaluate privacy & security. IMPORTANT to understand that under current interpretation, even an individual’s IP address connected to the AI tool could trigger privacy law issues. Need to consider HIPAA (consent/authorization & security risk analysis); 42 CFR Part 2; State Privacy Laws (CCPA, NJ new ones each day; FTC “unfair” or “fraudulent” consumer practices (see Better Help case); new EO protecting biometric data … the list evolves each week! 2. Regulatory Implications. For example, AI tool claims it can be used to assess patient for cognitive capacity in a more accurate, useful & efficient manner. Your BH org wants to use it because it will help your clinicians evaluate individuals with cognitive capacity issues better. Now you need to consider if it might be a “medical device” which is required to be registered with the FDA. Also, state licensing laws & CPM (corporate practice of medicine) doctrine could also be implicated. 3. Intellectual Property. Consider if you will be inputting confidential business information into an AI tool. Will that reveal something about your BH org that’s confidential and propriety? Will it reveal information in public domain? There are other legal considerations that the group discussed but perhaps the most important take away was NOT to become paralyzed by fear of AI!! BH organizations CAN (and should) be proactive with managing the risks associated with AI implementation. Here is how you can start to do it: 1. EDUCATE 🤓 your Boards & C suite about the importance of managing AI risks! Commitment to getting this right MUST come from the top down and so support from the top is a must! 2. Establish a AI committee or task force. Decide who’s going to be on it and prioritize your use cases & legal/compliance issues! 3. Begin to develop privacy policies and consents, other documentation. 4. Review AI vendor terms of use and contracts. 5. Determine how IT implementation fits into theworkflow. Make sure IT is involved with vetting for security issues! This is so important for data breach management. 6. Check your insurance policies! Make sure your organization is adequately covered for new risks! 7. After dotting your I’s & crossing your T’s, confidently “go live” with the latest and greatest AI solution! Need a place to start?
