In 2023, the Queensland Building and Construction Commission recorded a total of 189 adjudication applications, amounting to nearly $161 million in claims. Of the 189 adjudications, only approximately $46 million (29%) was successfully awarded to 125 claimants. The remaining 64 adjudications were dismissed because the respective adjudicator lacked jurisdiction to determine the dispute. Reasons for these dismissals often resulted from small but common oversights made by claimants during the adjudication process. Frequent occurrences of these oversights included: invalid service, invalid reference date, and invalid payment claims – each, costly errors that are easily mitigated. We outline a complete breakdown of the 2023 Queensland Adjudication Data results below. These graphics certainly highlight the importance of ensuring project teams understand what constitutes a valid application, payment claim and payment schedule under the Act. Too often do we see either opportunistic claims which fail to satisfy the terms of the contract, or claims with merit which cannot be awarded for failure to satisfy jurisdictional requirements of the Act. Now, wouldn’t it be great to see how many of those issues apply to applicants having sought advice vs those that have simply elected to give it a go for the sake of a $65 application fee.
