Sexual harassment often focuses on blatant acts. However subtle comments or behaviors (microaggressions) can be equally harmful, reinforcing stereotypes and marginalising individuals based on gender. Under the Sex Discrimination Act, organisations and businesses now have a positive duty to eliminate, as far as possible, the following unlawful behaviour from occurring: discrimination on the grounds of sex in a work context sexual harassment in connection with work sex-based harassment in connection with work conduct creating a workplace environment that is hostile on the grounds of sex related acts of victimisation. Regardless of their size or resources, all organisations and businesses in Australia that have obligations under the Sex Discrimination Act must meet the positive duty. This includes sole traders and the self-employed, small, medium and large businesses, and government. This new law requires employers to take reasonable steps to protect their employees from sexual harassment. Sexual harassment has a significant impact on employees mental health and wellbeing. It is your duty as an employer to ensure that there is no sexual harassment at work. Not only is this your legal duty, but it is also a wise commercial move. Allowing sexual harassment to proliferate at work will cost you dearly in the form of lawsuits, reduced productivity, and bad employee morale. Sexual harassment is forbidden by the same laws that forbid gender discrimination. The primary federal legislation that forbids sexual harassment is Title VII of the Civil Rights Act. Findings include 92% of the workforce has witnessed or experienced bullying or harassment on grounds of their sex or gender in the workplace. Six in 10 creative workers had experienced unwanted and/or inappropriate touching, hugging or kissing. A quarter has witnessed the circulation of pornography at work. Of the 56 film workers who responded, 98% said they had witnessed bullying or harassment on grounds of sex or gender in the workplace. One of the primary contributors to this problem is denial among senior leadership. Many leaders are either unable or unwilling to acknowledge that such incidents could occur within their own organisations. This denial not only undermines the experiences of victims but also perpetuates a culture of silence and impunity.
