Vicente has a great article explaining why everyone should temper their expectations around Schedule III. The biggest benefit is removal of 280E, which will be huge for cannabis businesses. But other than that, most of how we all operate will stay pretty much the same. Not to mention, it could still be a long time before Schedule III is official. Good read!

It is relatively easy to grow and does not require industrial processing. Marijuana can be produced anywhere by just about anyone. It is grown throughout the country, in backyards, closets, attics, basements, and warehouses. While little technology is needed to grow marijuana, ample technology to maximize production and yield are widely, legally, available. This is a considerable factor in why prohibition has failed to control the production of marijuana. European Cannabis Firms Eye Higher IPOs in the US Amid Rescheduling A growing number of European cannabis startups are considering initial public offerings (IPOs) in the United States, anticipating higher valuations in New York compared to London-based exchanges. This move hinges on the Biden administration's efforts to reschedule marijuana, according to the Financial Times and Euro News. Currently, U.S. law prohibits American cannabis companies from listing on major American stock exchanges. However, Canadian operators, where marijuana is federally legal, like Canopy Growth Corp. (CGC) and SNDL, are allowed to list on the Nasdaq. English and Portuguese Companies Interested England-based medical cannabis operator Grow Group has raised 12 million pounds (about $15.6 million) since its inception in 2017. The company previously declined to go public on the London Stock Exchange due to lukewarm investor interest. Now, with potential rescheduling in the U.S., CEO Benjamin Langly told the Financial Times he believes Grow Group can go public on the Nasdaq in early 2025 with a valuation of 100 million pounds. Similarly, Portugal-based cannabis exporter Somai Pharmaceuticals is eyeing a Nasdaq IPO, targeting a valuation of 250 million euros (approximately $273 million), CEO Michael Sassano told the FT. Recategorization Could Influence Exchanges: The U.S. Drug Enforcement The administration proposed moving marijuana from Schedule 1 to Schedule 3 of the Controlled Substances Act in May. Rescheduling is expected to make risk-averse stock exchanges and banks more open to engaging with the cannabis industry. Executives emphasize the importance of convincing investors that U.S.-based stock exchanges can avoid the boom-and-bust cycles experienced by cannabis companies currently listed in Canada, such as Canopy Growth and Tilray Brands, which have lost significant value since peaking shortly after Canada legalized recreational cannabis in 2018. New York regulators on Friday awarded 110 new adult-use marijuana business licenses. However, the yearslong struggle to launch what was promised to be a multibillion-dollar market is poised to continue. The state Cannabis Control Board on Friday voted to award: 24 cultivation licenses. 9 distribution licenses. 26 microbusiness licenses. 12 processor licenses. 25 retail licenses. 14 provisional retail licenses. It’s unclear how quickly the licensed businesses will be able to start operations. The 110 new licensees represent only a fraction of the entrepreneurs attempting to enter the market.
